Harvey Recovery Likely to Cause Workplace Safety Risks |

Recovering from Tropical Storm Harvey will be a dangerous process and can present multiple safety hazards to workers, according to experts.
One of the biggest workplace safety risks will be employees completing unfamiliar tasks in the process of recovering from the storm, which made landfall on the Texas Gulf coast as a Category 4 hurricane. The most immediate workers compensation implication will be workers who are injured helping to fix damage caused by the storm, according to experts.

Fort Worth Family Says Boy Scouts Responsible for Son's Hiking Death in lawsuit |

A recently filed lawsuit in Dallas County District Court blames negligence on behalf of the Boy Scouts of America for the death of a Fort Worth teen three months ago. Reid Comita,15, died from heat stroke while hiking at Buffalo Trail Scout Ranch in June. The new lawsuit outlines a series of allegations surrounding Reid's death, namely that he was "...sent on an extremely aggressive hike" in temperatures hovering around 100 degrees with a heat index well over that. The Comita family had specifically signed Reid up for an introductory backpacking class, under adult supervision, because they felt it was the safest option for their son.

Bullying, Assault Lawsuit to Challenge Tennessee Law Limiting Jury Award |

Legal experts say that a lawsuit against Tennessee's Brentwood Academy, which seeks $30 million for allegedly allowing a culture of bullying and sexual assault, could test the constitutionality of a controversial Tennessee law. The lawsuit will challenge a state law that bars plaintiffs from taking home more than $750,000 in a lawsuit, regardless of the amount awarded by a jury. "The statutory caps are an unconstitutional invasion into the right of a trial by jury and the jury's award of damages based on the evidence as triers of fact," stated an attorney for the plaintiff. The lawsuit was filed by the mother of a student at the Academy who allegedly suffered repeated sexual abuse by his classmates.
