2013 Making a Difference Award

TTLA is now accepting nominations for the Making a Difference Award' which is periodically awarded at the discretion of the TTLA Executive Committee and recognizes a client (past or present) of a TTLA member whose actions demonstrates the critical role of the civil justice system in protecting the rights of Texas families. Nominees should demonstrate a desire to promote the public good through the civil justice system and best exemplify the attributes of a true advocate. Nomination deadline is November 1, 2013. Family Files Lawsuit Over Teacher Who Molested Their Children

A California family filed a lawsuit last week over the sexual assault of their two boys by a teacher at their elementary school beginning in 2010. The teacher allegedly befriended the family and the children through phone calls, online chats, Disney toys and swim invites. The teacher was eventually arrested and charged with molesting 13 students in total. The lawsuit names the school district and six teachers as defendants in the case.

Medication Policy Changes In Texas Jail Impacts New Lawsuit

A $1.9 million settlement for the family of a Texas inmate who died when not given access to her prescribed medications may impact other cases. A similar case was filed against the county in March by a mother who claims her son died because he was denied prescription methadone for his heroin addiction. That case is scheduled to be heard at the U.S. District Court in Marshall next month.

Settlement Reached in Hospital Rape Lawsuit

The lawsuit filed by a woman who claimed she was raped by a nurse at a Las Vegas hospital has reached a settlement. The plaintiff claimed she was sexually assaulted multiple times during her stay at the hospital by one of the male nurses, who has been accused of similar actions by five other women. The details of the settlement between the woman and the Las Vegas medical center are confidential.

Fire Company Wants Out of DUI Crash Lawsuit

A volunteer fire company out of Lebanon County, Pennsylvania is requesting that a judge release them from being defendants in a lawsuit over the fatal alcohol-related accident of a 19-year-old boy. The lawsuit, filed by the boy's mother, claims that the fire company is responsible for the boy's death because it was their social club that the boy left from intoxicated. The plaintiff claims that the fire company should have stopped the boy from driving, as his blood alcohol level was twice the legal limit.

Deaths from Compounded Drugs Revive Debate on Expanding the FDA's Powers

Faced with a warning by the FDA urging doctors and patients to stop using its medicines after three patients got sick, NuVision Pharmacy pushed back. It told customers that it would continue business as usual and that its products are safe and rigorously tested. The FDA, the company said in a letter posted on its website, should butt out because NuVision is not a drug manufacturer, but rather a pharmacy that modifies drugs for people across the country who can't tolerate them in their usual form. These compounding pharmacies have been around for as long as druggists have made individualized medicines for patients. But as margins get tighter in the ultracompetitive pharmacy business, more large-scale operators like NuVision are being formed to ship the modified drugs across state lines.

State Investigates New Complaint of Methane Contamination in Parker County

A Parker County couple who live near natural gas wells told the Texas Railroad Commission their well water has become badly contaminated with methane. According to Railroad Commission inspection reports, Carroll Dawson and his wife said they have been told that tests of water and air inside their home revealed high methane levels. The reports were first reported by EnergyWire, an online news service, which said Railroad Commission inspectors visited at least four households in the area.
