Family Files Suit Against Kansas City Diocese

A Missouri couple has filed a wrongful death lawsuit against the Kansas City-St. Joseph Diocese and a former priest. The lawsuit claims that the couple's son committed suicide in 1983 because he was "repeatedly sexually abused" by the now-retired priest. The family said that a former classmate of their son called them a few months ago and detailed the abuse both he and their son went through as kids. Ohio Woman Settles Privacy Suit with Software Co.

An Ohio substitute teacher has settled a lawsuit she filed against a software company for allegedly violating her privacy by giving sexually explicit photos of her to the police. The suit alleged the software company used anti-theft software to access a laptop she bought from a student and took snapshots from her webcam while she was talking to her boyfriend. The laptop, unbeknownst to her, was stolen, the suit says, and the photos were given to police. Charges against her were dropped.  Debra Cassens Weiss, American Bar Association Journal  09/07/2011

Suit Filed Against Yale over Murdered Student

The family of a former Yale student who was murdered in a school laboratory has filed a lawsuit against the school, accusing the school of negligence. The lawsuit claims school officials should have been aware that Raymond Clark, who was convicted of the 2009 murder, posed a potential threat because he "previously demonstrated aggressive behavior and a violent propensity towards women." Damages Ruling May Be Pivotal in BP Gulf Oil Case

A key court ruling in the Gulf of Mexico oil spill litigation could change the landscape in the massive case — encouraging more plaintiffs to sue, or spurring the parties to make a deal to resolve what could be a long string of trials over damages. Last week, the judge overseeing a group of spill-related lawsuits against BP Plc and its business partners ruled that claims for punitive damages — not just compensatory damages — could be brought by fishermen and other plaintiffs alleging harm to physical property.  Moira Herbst, Reuters  09/07/2011

Minnesota: Catholic Diocese Settles Abuse Case

The Roman Catholic Diocese of Crookston has agreed to pay $750,000 to settle a lawsuit with a 21-year-old woman who said she was sexually molested as a teenager by a priest from India who was serving parishes in the diocese. The victim, Megan Peterson, said the Rev. Joseph Palanivel Jeyapaul sexually abused her when she went to speak to him about becoming a nun.  LAURIE GOODSTEIN, The New York Times  09/07/2011

Ad Firm, Two Doctors Sued Over Death of Lap-Band Patient

Relatives of a Lawndale woman who died in December after Lap-Band weight-loss surgery have sued the 1-800-GET-THIN advertising company and two doctors involved in her care. The lawsuit contends that the ad company falsely represented that the woman would receive "a higher level of care" by "top-rated surgical specialists." In fact, the lawsuit said, one of her doctors was on probation with the Medical Board of California at the time of the surgery and a second was under investigation by the agency.  Stuart Pfeifer, LA Times  09/07/2011

Employee Class-Action Suit Filed Against Solyndra

A former employee at the energy company Solyndra has filed a class-action suit against the company, claiming it violated federal laws by not giving its employees proper notice before filing for bankruptcy. The suit claims employees were notified suddenly and without warning that they no longer had jobs. State and federal laws require companies to give 60 days notice before the elimination of 50 or more employees.  George Avalos, San Jose Mercury News  09/06/2011

Shell to Pay $500,000 for Pollution

Shell Chemical LP has agreed to pay $500,000 to Harris County after failing to promptly report high levels of harmful chemicals released into the air from its Deer Park plant. Harris County Attorney announced the agreement Tuesday as part of a campaign to ensure that industrial polluters notify local authorities of excess emissions within 24 hours, as required by law.  MATTHEW TRESAUGUE, Houston Chronicle  09/07/2011
