The plaintiff says she had been drinking heavily and does not remember having sexual contact with anyone, but after hearing gossip, she became concerned that she had sex with several people. The lawsuit asks that the school's superintendent remove himself from deciding whether or not the men will be court-martialed, as he has done "nothing to prevent lengthy and abusive testimony during a military court hearing on the accusations." The incident is the second-largest loss of private health information reported to the Department of Health and Human Services since it began requiring notification of such issues in 2009. The lawsuit is headed to trial in January and is seeking damages for violation of privacy and emotional distress. The recall comes about a week after the company first started asking retailers to pull the products from shelves, saying some cups were "swelling and bloating." Chobani had previously said it wasn't issuing a formal recall. Dr. Joseph Pepe, president of Catholic Medical Center in Manchester, said officials are 95 percent certain that a patient who had brain surgery in May and died in August had sporadic Creutzfeldt-Jakob Disease. Rick Perry signed into law this year requires that insurers who sell “named driver†auto policies disclose the limits of the coverage to drivers. They must also list the names of covered drivers on insurance ID cards they issue to customers. Under such policies, often called “junk†policies, coverage is restricted to one person listed as the driver. They do not cover family members in the household. That means when family members other than the named driver use a family vehicle, they have no insurance protection. The suit alleges the doctors and nurses did not properly monitor her or provide quick treatment when she contracted necrotizing fasciitis while giving birth in August 2007.
