A year-long USA TODAY Network investigation found that some port trucking companies have successfully used legal loopholes, shell companies and bankruptcy protection to dodge the punishment labor court judges have handed down. Itâ??s the latest revelation in an ongoing investigation into how port trucking companies that serve the nationâ??s top retailers take advantage of drivers, often forcing them to work around the clock while paying them pennies per hour.

Mothers File Suit Against Pop Warner Over Sons' CTE Deaths |

A lawsuit filed by two mothers who allege their sons died of injuries related to brain trauma suffered while playing youth football will be heard by a California court. The lawsuit was filed against the national Pop Warner program and alleges that its actions led to brain injuries that may have caused the disease chronic traumatic encephalopathy (CTE). The lawsuit alleges that Pop Warner "misrepresented that safety was its top priority," bragging that it had "coaches trained in head injuries, equipment that afforded the best protection, and rules and procedures designed to protect children from injuryâ??all with the knowledge that none of this was true."

Oklahoma Supreme Court Says Malpractice Law Unconstitutional |

The Oklahoma Supreme Court says a state law designed to deter the filing of frivolous medical malpractice lawsuits is unconstitutional. The Oklahoman reports that the Tuesday decision is the third time the court has struck down similar legislation. The court struck down versions of the law in 2006 and 2013. The law requires a person filing a lawsuit to include an affidavit from an expert witness that says the claim has merit. The court says the statute created "a costly, meaningless and arbitrary barrier to court access" and infringed on the district court's authority.

Testing older physicians for mental and physical ability is growing more common. Nearly a fourth of physicians in America are 65 or older, and 40% of these are actively involved in patient care, according to the American Medical Association. Experts at the AMA have suggested that they be screened lest they pose a risk to patients. An AMA working group is considering guidelines. Concern over older physiciansâ?? mental statesâ??and whether it is safe for them to care for patientsâ??has prompted a number of institutions, from Stanford Health Care in Palo Alto, Calif., to Driscoll Childrenâ??s Hospital in Corpus Christi, Texas, to the University of Virginia Health System, to adopt age-related physician policies in recent years. The goal is to spot problems, in particular signs of cognitive decline or dementia.
