An Illinois federal judge on Wednesday declined to apply a California statute of limitations to a womanâ??s suit alleging her child suffered birth defects from her use of Depakote during pregnancy, nixing Abbott Laboratories Inc.â??s bid to toss her claims. U.S. District Judge Nancy J. Rosenstengel said Abbott seemed to assume that the statute of limitations from the jurisdiction from where a case is first filed should then be imported to any subsequent jurisdiction.

Judge Consolidates Challenges to New Overtime Pay Rule

A federal judge on Wednesday granted a bid by the U.S. Chamber of Commerce and other business groups to consolidate their challenge to a new Obama administration rule extending mandatory overtime pay to millions of workers with a similar lawsuit by 21 states. U.S. District Judge Amos Mazzant in Sherman, Texas agreed to merge the two cases, both of which claim the U.S. Department of Labor exceeded its authority in issuing the rule in May.

Hyundai Recalls Midsize Cars; Sunroofs Can Fly Into Traffic
spacer image
Hyundai is recalling nearly 63,000 midsize cars in the U.S. because the panoramic glass sunroofs can come loose and fly into traffic. The recall covers certain Sonata midsize cars from the 2015 and 2016 model years, including gas-electric hybrids. The South Korean automaker says in government documents that a wind deflector anchor plate in front of the sunroof wasn't bonded properly to the car. A loose deflector can detach and interfere with the roof as it closes. If the owner tries to force the roof closed, it can fly off.

Wrongful Death

Family of Murdered Teacher Files Suit Against Massachusetts Town, School
spacer image
A wrongful-death lawsuit has been filed over the murder of a teacher from Danvers, Massachusetts. The family of the 24-year-old teacher, who was killed by a student in a school restroom, filed suit against the town of Danvers and Danvers High School. The then-14-year-old student who killed the teacher was convicted last year of rape, robbery and murder. The lawsuit was filed Tuesday in Essex Superior Court, three years after the teacher's murder. Instead of personal financial compensation, the lawsuit seeks answers to what happened when the teacher was killed and money to "enhance school safety programs and to contribute to the legacy of [the teacher] through third-party nonprofit organizations."

Ohio Family Awarded $2M in Hospital Misdiagnosis, Death Lawsuit
spacer image
Nearly $2 million was awarded to the family of an Ohio woman who died due to a mistake at an emergency room. The 31-year-old woman died in Oct. 2014 of pulmonary embolism after University Hospitals Avon Health Center Emergency Room staff misdiagnosed her blood clot. The woman went to the hospital and told staff that she was having back pain. Despite doctors being aware that the woman was taking birth control medication that heavily increased her risk of deep vein thrombosis, they diagnosed her with back pain. A jury recently awarded the woman's family $1.9 million in the wrongful-death lawsuit.

The principal of Houston ISD's Madison High School is facing a wrongful-death lawsuit by the family of a woman killed in a car crash with the school official. The lawsuit was filed over the death of one woman who was killed when the principal's car hit a barrier and landed on top of the woman's car. The woman was killed instantly when the 40-year-old principal's car became airborne and landed on her vehicle. The principal was not tested for intoxication because law enforcement said they did not see any signs of intoxication after the incident.
