Supreme Court Will Weigh Corporate Liability for Alleged Abuses Overseas

The Supreme Court said Monday it will use a dispute between Nigerian villagers and oil giant Royal Dutch Shell to decide whether corporations may be held liable in U.S. courts for alleged human rights abuses overseas. The justices said they will review a federal appeals court ruling in favor of Shell. The case centers on the 222-year-old Alien Tort Statute that has been increasingly used in recent years to sue corporations for alleged abuses abroad.  Associated Press, The Washington Post  10/18/2011

David Lazarus: Bill Aims to Restore Consumers' Right to Sue

spacer image

Legislation under consideration in Congress would supersede the Supreme Court's ruling that said companies could force disputes into arbitration — a process that consumer advocates say tips the scales of justice in favor of businesses. The bill's chances of getting out of the Republican-controlled House are pretty much slim to none at the moment. But supporters say the groundwork is being laid for passage down the road. So-called arbitration clauses have become standard practice for a wide variety of consumer and employee contracts.  David Lazarus, LA Times  10/18/2011
