2013 Making a Difference Award

TTLA is now accepting nominations for the Making a Difference Award which is periodically awarded at the discretion of the TTLA Executive Committee and recognizes a client (past or present) of a TTLA member whose actions demonstrates the critical role of the civil justice system in protecting the rights of Texas families. Nominees should demonstrate a desire to promote the public good through the civil justice system and best exemplify the attributes of a true advocate. Nomination deadline is November 1, 2013. Woman Severly Injured by Police Officers Files Suit

A Chicago woman who sustained serious injury when police threw her headfirst into a jail cell bench after a DUI arrest has filed a lawsuit against the village of Skokie and one of its police officers. The plaintiff claims that because of the incident she had to undergo facial reconstructive surgery where doctors inserted a titanium plate to replace the shattered bones in her face. Video footage of the incident was recorded on cameras in the jail. In addition to the DUI charge, officers charged the plaintiff with resisting a police officer; a charge that was later dropped by county officials. The lawsuit alleges that the officer who threw the plaintiff into the cell made false statements and had other officers help him cover up the incident.

Lawsuit Over Coach Whipping Students Is Settled

A federal lawsuit filed on behalf of three high school basketball players against their coach who had a habit of whipping students has been settled. The Mississippi high school coach regularly whipped his basketball players with a belt for missing plays in practice even though corporal punishment was banned in 1991. The coach was initially fired, but then reinstated and allowed to accept a 25-day suspension from coaching; however, he is no longer employed at the school. Terms of the settlement have not been disclosed.

Girl Files False Arrest Lawsuit Against Ohio Police

A girl whose mother was killed by a police officer when she was just 11 years old is now able to file a lawsuit against the police department for arresting her three years later. The lawsuit alleges that police officers falsely arrested and imprisoned the then 11-year-old girl for making obscene gestures at them after the death of her mother. The lawsuit further alleges retaliation charges, based on the fact that the plaintiff's family had just received a $2.5 million wrongful-death settlement from the city's insurance carrier. "A three-judge panel of the U.S. 6th Circuit Court of Appeals in Cincinnati unanimously found that police did not have grounds to arrest the 11-year-old girl."

Toyota Found Not Liable in Acceleration Case

Los Angeles jurors ruled for Toyota in a suit that had claimed a design defect in a 2006 Camry made it impossible to stop after being struck by another car. The Camry driver, Noriko Uno, died in the accident. While jurors cleared Toyota, they did award $10 million in damages for negligence of the 86-year-old driver who struck Uno's car.

Jury Absolves BP in Gas Leak Trial

A massive release of noxious gas from a former BP refinery in Texas City caused no harm or nuisance to three people who lived nearby, a Galveston County jury said Thursday. The jury of eight women and four men absolved BP of any wrongdoing in a 2010 release of toxic gases that continued for at least 40 days. The verdict, which came after a monthlong trial, is a test case for an estimated 48,000 other claims brought by residents near the plant in scores of other lawsuits.

Recall Issued on Burgers Due to E.coli Contamination

A recall has been issued on President's Choice Thick & Juicy Burgers due to a potential E.coli contamination. Loblaw stores across Canada are asking the public not to consume the product as it may be contaminated with E.coli which could lead to serious illness. The company has removed all products from stores. There have been no reports of consumer illness.
