The $20.8 billion deal is the largest settlement with a single entity in American history and includes the largest civil penalty in the history of environmental law. It resolves all state claims against the company for its role in the disaster, which killed 11 people and spewed millions of barrels of oil into the Gulf of Mexico. Pham is suing the hospitalâ??s parent company, Texas Health Resources, saying that it did not adequately train and protect its nurses from the disease. THR argued Monday that the civil court does not have jurisdiction because Phamâ??s claim should be decided by a workerâ??s compensation claim.The workerâ??s compensation claim will also go forward. But state District Judge Martin Hoffman will still determine who employed Pham for the purposes of the lawsuit. Parents File Suit Against Drug Giant Over Birth Defects | | A lawsuit has been filed by a California couple whose daughter suffered injuries as a result of the mother being prescribed Zofran while pregnant. The lawsuit seeks to hold GlaxoSmithKline LLC, the maker of the drug, accountable for the alleged injuries the girl suffered as a result of her mother taking the drug. Three years ago, the pharmaceutical company pled guilty to criminal charges filed by the U.S. Department of Justice for off-label promotion of certain prescription drugs, including Zofran, for uses not approved by the FDA. The lawsuit was filed on Monday and contends that 3M has been aware for 14 years that the chemicals "are not effectively treated by conventional wastewater treatment plant processes." Nearby residents are at risk of cancer and other health complications because of the chemicals, the lawsuit states. The chemicals are being leaked into the Tennessee river which supplies water to residents of Decatur. The 14-year-old boy shot himself with his father's gun in the bathroom at a Lake Mary middle school last year. The lawsuit, filed by the boy's family, alleges that school did not do enough to prevent the bullying that led to the boy's suicide. According to the lawsuit, the boy was missing for hours and administrators did not look for him, even after a student found a shell casing in the bathroom.
