Privacy Not Included: Federal Law Lags Behind New Tech

The HIPAA, a landmark 1996 patient-privacy law, only covers patient information kept by health providers, insurers and data clearinghouses, as well as their business partners. At-home paternity tests fall outside the law's purview. For that matter, so do wearables like Fitbit that measure steps and sleep, testing companies like 23andMe, and online repositories where individuals can store their health records. In several instances, the privacy of people using these newer services has been compromised, causing embarrassment or legal repercussions.

Arkansas Awards $2M to Family of Boy Whom Doctors Left Brain Damaged

The state of Arkansas has awarded $2 million to the family of a man who was left permanently brain damaged after doctors operated on the wrong side of his brain. The state's Claims Commission announced on Tuesday that doctors at the Arkansas Children's Hospital were negligent in the surgery on the 15-year-old boy's brain. The surgery took place in 2004 and doctors were attempting to reduce the number of seizures the boy was experiencing. Because doctors operated on the wrong side of the boy's brain, he was left permanently impaired.

Case Against Controversial Cancer Doc Finally Headed to Court

The Texas Medical Board and Stanislaw Burzynski are set for a high-stakes showdown that could determine whether the controversial Houston alternative cancer doctor can stay in business. State lawyers will set out Thursday to start trying to convince two judges that Burzynski violated state medical rules, which could cause him to lose his license. State officials will lay out their case, nearly two years after they filed a formal complaint and two decades after the federal government tried unsuccessfully to get the doctor imprisoned for interstate commerce of experimental drugs. The drugs, commonly known as anti-neoplastons, an unproven and oft-criticized type of chemotherapy that Burzynski devised, also are at the center of the state's case. The medical board is alleging the doctor promoted his experimental therapy to patients, knowing he could not legally provide it to most of them, and that he disregarded patient safety, among other accusations, according to the complaint.

Payday Lending Rules Apply to Litigation Funding, Colorado Court Rules

The highest court in Colorado dealt a setback to the consumer legal funding industry, ruling that businesses that offer cash advances to plaintiffs in personal injury cases should be subject to payday lending rules. The Colorado Supreme Court sided with the state in Colorado's long-running legal battle against two national litigation funding companies, Northbrook, Ill.-based Oasis Legal Finance LLC and Brooklyn-based LawCash.

MSU Students File Sexual Harassment Lawsuit Against University

Four female students at Michigan State University have filed a lawsuit alleging that the school mishandled their sexual assault cases. One of the women alleges that she was sexually assaulted by a classmate who had violated the school's sexual harassment policy just two years earlier. The lawsuit was filed in federal court on Wednesday and contends that the school delayed investigations and appeals and, in doing so, allowed the male students to sexually assault the plaintiffs. Officials at the university have not commented on the lawsuit.
