Jury Sides With Repo Man Involved in Altercation | | The lawsuit brought by a man who was injured when he attacked a repo man has ended in the jury ruling in favor of the defendant. The defendant had come to repossess the plaintiff's luxury sedan when he was attacked. In the altercation, the plaintiff ended up with a broken finger, had his face pepper-sprayed and was hit with a stun-gun by police officers. The lawsuit claimed that the actions of the defendant and police officers "were excessive and caused emotional and physical pain that lingers, affecting Franklin Duncan’s work as a fishing lure patent-holder and sketch artist." Family of Police Officer Killed in Crash Awarded $8.5M | | The wife and daughter of a police officer from Oakdale, California have been awarded $8.5 million in a wrongful death lawsuit. The suit was filed after the police officer's car was hit by a driver employed by Gold Star Foods Inc., who was severely fatigued from lack of sleep. The police officer, who was taking his baby daughter to stay with a family member, was killed instantly from the impact. According to court papers, the driver had falsified his driving records, claiming that he had slept while he was actually driving. The attorney representing the officer's widow and daughter says, "It is one of, if not the largest, settlement for a single wrongful-death case in Stanislaus County." Police Who Shot and Killed Dog are Facing Lawsuit | | A lawsuit has been filed in civil court against the city of Commerce City, Colorado over the fatal police shooting of a therapy dog. The Animal Law Center recently filed the lawsuit on behalf of the dog's owner. The 3-year-old dog was shot and killed by police officers who were responding to reports of the dog running around the neighborhood. After being unable to catch the dog using catchpoles and a Taser, one of the officers shot the dog five times. The incident was caught on video by a neighbor. Study: Rise in Spinal Fusion Surgeries may be Driven Partly by Financial Incentives | | A government study of Medicare billings shows that financial incentives for doctors may be driving some of the rapid rise in spinal fusion surgery. The report, conducted by the Office of Inspector General of the Department of Health and Human Services, focuses on the “proliferation†of companies that are owned by physicians and sell equipment for spinal fusions — screws, rods and plates.
