AAJ Report: Do As I Say, Not As I Sue

spacer image

The Institute for Legal Reform (ILR), an arm of the U.S. Chamber of Commerce, has the sole mission of restricting the ability of individuals harmed by negligent corporations to access the civil justice system. According to the multinational corporations that finance ILR, American businesses are hindered by too many lawsuits. Yet these same corporations show no hesitation in liberally using the courthouse themselves. Click on the headline to read more.

Fatal Air Crash in Reno Prompts Lawsuit

spacer image

The family of a Texas man killed at the National Championship Air Races in Reno when a plane slammed into the box seats has filed a $25 million lawsuit against multiple parties involved in the races. The lawsuit claims the crash "was the predictable result of a reckless drive for speed by a risk taking pilot and crew," and also names race organizers as defendants. Investigators believe that a piece of the plane that keeps the nose down may have snapped off shortly before the crash.  Ashley Powers, Los Angeles Times  11/01/2011

Suit: Three Kansas City Priests Abused Boy

A Missouri man has filed a lawsuit against the Kansas City-St. Joseph Diocese and three priests, claiming they sexually abused him in the early 1980s when he was a young boy. The suit claims most of the abuse took place at Nativity of the Blessed Virgin Mary parish, where the plaintiff attended grade school. Memories of the abuse surfaced in recent years, the man said, and he has attempted suicide on multiple occasions as a result.  Judy L. Thomas, Kansas City Star  11/01/2011

he federal government sued one of the nation’s largest privately held mortgage brokers on Tuesday, saying its decade-long lending practices amounted to fraud and cost the government hundreds of millions of dollars and forced thousands of American homeowners to lose their homes. The lawsuit in United States District Court in Manhattan sought unspecified damages and civil penalties and named as defendants Allied Home Mortgage Corporation; its founder, Jim Hodge; and Jeanne Stell, the company’s executive vice president and director of compliance.  Associated Press, The Washington Post  11/02/2011

Judge Tosses $20 Billion in Claims

n one of the biggest blows to efforts by the trustee seeking to recover money for victims of convicted Ponzi-scheme operator Bernard Madoff, a federal judge has thrown out about $20 billion in claims made against J.P. Morgan Chase & Co. and UBS AG. The decision is the latest in a series of losses by court-appointed trustee Irving Picard in lawsuits against major financial institutions he has attempted to hold accountable for allegedly aiding Mr. Madoff's scheme. The ruling almost certainly quashed his hopes of collecting billions of dollars from J.P. Morgan,  CHAD BRAY AND MICHAEL ROTHFELD , Wall Street Journal - $$ Subscription Required  11/02/2011

The Supreme Court wrestled Tuesday with whether government officials are protected from civil lawsuits, even if they tell lies that lead a grand jury to vote for an indictment. The justices heard arguments in an appeal from Charles Rehberg, an accountant who was indicted three times involving charges that he harassed doctors affiliated with a south Georgia hospital system.  Associated Press, The Washington Post  11/02/2011

Court Seems Unlikely to Allow Suit Against Privately-Run Federal Prison

The Supreme Court seemed unlikely on Tuesday to allow employees at a privately run federal prison to be sued by an inmate in federal court, despite his complaint that their neglect left him with two permanently damaged arms. Justices heard appeals from lawyers representing employees of the GEO Group, formerly known as Wackenhut Corrections Corp, who work at the privately run Taft Correctional Institution in Taft, Calif. The 9th U.S. Circuit Court of Appeals had ruled inmate Richard Lee Pollard could sue GEO officials for his treatment after he fell and fractured both of his elbows.  Associated Press, The Washington Post  11/02/2011
