In Weighty Water Ruling, Texas' High Court Backs Landowner |
The Texas Supreme Court has strengthened protections for landowners who don't have rights to the water underneath their property. In a ruling Friday, the state's highest civil court said Texas' "accommodation doctrine" should also apply to groundwater, in addition to oil and gas. The decades-old doctrine requires mineral owners — considered the dominant estate — to accommodate the surface owner's existing use of the land if at all possible. While it doesn't always stop drilling or pumping operations, the doctrine gives surface landowners some say regarding the circumstances. AZ Wants VW Lawsuit Heard in State, Not Federal, Court |
Attorneys for the state are fighting the desire by VW to have the lawsuit against the company handled in federal court by a federal judge. In new legal filings, assistant AG O.H. Skinner is telling U.S. District Court Judge Roslyn Silver that Arizona's case against the German automaker is different than those filed by other states in the wake of disclosures the company cheated on its emission testing. Most of the other lawsuits are based on Volkswagen violating federal air quality standards. But Arizona's claim is that the company defrauded consumers here by advertising and selling a low-emission vehicle that it never delivered.
