The lawsuit, filed by the widow of a man who became infected by one of the devices and later died, originally named the hospital as a defendant. The lawsuit is now filed solely against Olympus America, the maker of the infected duodenoscope. The "superbug" transmitted by the use of the medical devices has a fatality rate of about 40% and is resistant to "last defense" antibiotics. The lawsuit was filed by the family of the girl who was injured when her face slammed into the back of a seat during a log ride. The girl was knocked unconscious and she sustained a broken orbital bone and vision problems. According to the lawsuit, the ride has caused injury to nine other children between 2000 and 2014.
