Disposal Well Operators Near Quake to Stop Operations

Following a 4.0-magnitude earthquake Thursday in Johnson County, four disposal well operators who operate five wells near the epicenter have agreed to temporarily shut down operations while conducting testing required by the Texas Railroad Commission. Last month, an SMU geology study of an earthquake swarm in Azle in 2013 and 2014 found "high volumes of wastewater injection combined with saltwater (brine) extraction from natural gas wells [was] the most likely cause of earthquakes" in that area.

Galveston Bay Home Owners Sue Over Ship Channel Tanker Collision, Chemical Leak

Four property owners claiming damage from a Houston Ship Channel tanker collision are suing the shipping companies and two pilot organizations. Filed in Harris County's 234th State District Court by four Morgan's Point homeowners, the suit names, among others, the Maersk Group and Conti Group shipping companies as well as the Houston Pilots Association and Beatty Street Properties, which both provide pilots to navigate large ships in and out of the Port of Houston. The suit concerns the March 9 collision in heavy fog between the double-hulled tanker Carla Maersk and the bulk carrier Conti Peridot. According to the plaintiffs' petition, the Carla Maersk was carrying about 216,000 barrels of methyl tertiary butyl ether, or MTBE. The collision ruptured two of the Carla Maersk's cargo tanks, resulting in an unknown quantity of the gasoline additive to spill into the water off Morgan's Point, according to the lawsuit. An approximately 8-foot wave of the chemical washed onto the plaintiffs' properties on Bayridge Road, the petition states.

Family of Deceased Disney Park Worker Gets Lawsuit Hearing

A hearing has been scheduled for today in a lawsuit filed by the family of a worker at Walt Disney Parks and Resorts who died while working at one of the park's rides. The lawsuit was filed in Orange County Circuit Court in 2012 after the death of the maintenance worker who died when he was struck by a ride vehicle while performing maintenance in 2011. Disney is seeking the lawsuit's dismissal, claiming that the family is already entitled to benefits under workers' compensation.

Widow of Veteran Files Suit Over Misdiagnosis

The widow of an Arizona man who committed suicide after a misdiagnosis by a Phoenix veterans medical center has filed a wrongful death lawsuit over his death. According to the lawsuit, filed April 30 with the U.S. District Court in Phoenix, the hospital called the couple's home and informed the husband that his cancer had invaded his lungs and that he did not have long to live. After the news, the husband shot and killed himself. The day after his death, the hospital called to say that they had given him a misdiagnosis. The lawsuit seeks damages for emotional and economic injury, lost wages, lost opportunity for financial gain, future earning capacity, loss of consortium, loss of love and affection.
