STUDY: REASONS FOR REVERSAL IN THE TEXAS COURTS OF APPEALS

The study published in the Houston Law Review (www.houstonlawreview.org/) conducted by Lynne Liberato and Kent Rutter who are partners in the Houston office of Haynes and Boone, reviewed 1,832 opinions issued from Sept. 1, 2010 to Aug. 31, 2011. The appellate law experts read each case and determined who had won and why. Unlike the Texas Supreme Court, which has discretion to hear appeals, the lower appellate courts must consider all that are filed. Click on the headline to access the study.

Chrysler Group Recalls 127,000 Vehicles

Chrysler has issued a recall of more than 127,000 Dodge Charger and Chrysler 300 vehicles in the U.S. and Canada due to electrical problems. The company said a fuse in the power distribution center may overheat and cause the driver to lose control of the vehicle. The company said they have not received any reports of injuries or crashes due to the issue.  Bernie Woodall, Reuters  05/07/2012

LA Teacher Abused Students, Suit Says

A group of 20 former students at Miramonte Elementary School in Los Angeles have filed a lawsuit against the school district over accusations of sexual abuse by a former teacher. The lawsuit claims school officials ignored allegations against the teacher, some going back to 1993, and nothing was done to protect the students. The teacher was fired last year and has been charged with 23 counts of lewd acts on children.  Nicole Santa Cruz, LA Times  05/05/2012

Discrepancy over Lotto Winnings Prompts Suit

A Chicago woman who won a $51 million lottery jackpot has filed a lawsuit against her son, claiming he swindled her and her husband out of their winnings. The suit claims the son has placed the money into accounts that the plaintiffs cannot access and is spending the money without their consent or direction. The suit is seeking damages of $32.3 million - the amount of the lump sum payment the woman took as winnings.  Jason Kotowski, Chicago Tribune  05/04/2012

Corpus Christi Jury Awards $24M to Woman Struck by Coca-Cola Driver on Cellphone

A Corpus Christi jury awarded $24 million ­Friday to a woman struck in 2010 by a Coca-Cola driver who was using a cellphone. Vanice Chatman-­Wilson, 37, was awarded $10 million in punitive damages and $14 million in actual damages. Coca-Cola’s cellphone policy requires the use of a hands-free device when operating a vehicle, according to a statement released by the company. Chatman-­Wilson's attorneys said the $10 million in punitive damages was the jury’s way of telling Coca-Cola Enterprises that it needs to change its cellphone policy.  Michelle Villarreal, Corpus Christi Caller Times  05/07/2012

University Professor Files Racial Discrimination Suit

A professor at Old Dominion University has filed a lawsuit against the school, accusing school officials of racial discrimination. In her suit, the Caucasian female professor claims she was denied tenure and told she would not be employed after next year in retaliation for complaints she filed against an Asian-American colleague. The plaintiff outlines in her suit a chain of events allegedly showing the school's "policy and practice of racial favoritism toward minority employees."  Bill Sizemore, Virginian Pilot  05/07/2012

Wrongful Death Hit-And-Run Lawsuit Settled

A settlement has been reached in a wrongful death lawsuit over a fatal hit-and-run accident at a Minnesota gas station. The lawsuit accused the woman responsible - the wife of former Minnesota Viking Joe Senser - of negligently fleeing the scene after the accident and failing to stop and help the man she hit. Last week Amy Senser was convicted of two felony counts of criminal vehicular homicide. The terms of the settlement were not disclosed.  Wire Report, The Washington Post  05/04/2012

Death of Utah Officer Sparks Wrongful Death Suit

The death of a Sevier County, Utah, sheriff has prompted a lawsuit from his family against the driver involved in the crash and the state's transportation department. The officer was hit by a car while investigating another accident on a local bridge, falling 250 feet to his death. The suit claims the driver who hit the victim was speeding and lost control on the icy road. The suit is seeking unspecified damages.  Aaron Falk, The Salt Lake Tribune  05/02/2012
