Fla. Court Says Nursing Home Suit Belongs In Arbitration

A Florida appellate panel ruled Wednesday that a suit accusing a nursing home of violating state regulations in connection with a patient's death belongs in arbitration, saying the arbitration agreement signed by the patient's daughter was not unconscionable. A three-judge Fourth District panel overturned a trial judge's denial of Pompano Health and Rehabilitation Center's motion to compel arbitration in a suit accusing the nursing home of violating Chapter 400 of the Florida Statutes.

Poor Patient Care at Many Nursing Homes Despite Stricter Oversight

While special focus status is one of the federal government's strictest forms of oversight, nursing homes that were forced to undergo such scrutiny often slide back into providing dangerous care, according to an analysis of federal health inspection data. Of 528 nursing homes that graduated from special focus status before 2014 and are still operating, slightly more than half — 52 percent — have since harmed patients or put patients in serious jeopardy within the past three years.

Venus Williams Facing Wrongful Death Suit Over Florida Car Accident

Professional tennis player Venus Williams is facing a wrongful death lawsuit over a fatal car crash that took place in Florida. The lawsuit was filed by the widow of the 78-year-old man who died two weeks after the Palm Beach Gardens crash. Witnesses to the crash told police that Williams ran a red light and was unable to avoid crashing into the plaintiff's car. The lawsuit seeks unspecified damages for loss of companionship, loss of earnings, pain and suffering, and medical and funeral expenses. Williams was driving 5 mph at the time of the crash and there has been no evidence that alcohol, drugs or texting caused the crash.
