Law Prevents Some Family Members From Suing the Military |
The Supreme Court has received at least three petitions in the past decade to rethink Feres, mainly medical malpractice cases. Bills also have been introduced in Congress in the same period to clarify the law that set the Feres precedent back in 1950, the Federal Tort Claims Act. Families, even those with active-duty members, can sue the government for negligence under the Federal Tort Claims Act. Troops themselves, however, cannot sue the government for personal injuries caused by the negligence of military members, including those providing medical care. Oklahoma Law Caps Damages Awarded to Hurt Worker |
A jury last month awarded millions in damages to an oil rig manager who lost his arm because of a 2012 crane accident, but an Oklahoma law the jurors were unaware of reduced the verdict dramatically. The unusual outcome, caused by a tort reform law that went into effect in 2011, is believed by the judge who presided over the case to be a first in Oklahoma County District Court. Church-Affiliated School Settles Sex Abuse Lawsuit |
A sexual abuse lawsuit filed against an Oklahoma church has been settled for $260,000. The lawsuit was filed against Moore Christian Schools by the guardian of a girl who was allegedly sexually abused by a teacher at the school. The lawsuit was filed in 2012 and alleged that the girl faced sexual abuse by the teacher beginning when she was 13 and he was 64. The teacher is currently facing 18 felony counts in Cleveland County District Court. The lawsuit was settled by the school's insurer and is not an admission of liability. Texans' Average Home Insurance Premium Increases 7% to 8% |
Home insurers have raised their premiums an average 7 percent to 8 percent this year, despite healthy profits and below-average property losses, new filings with the state show. Leading the way is State Farm Insurance, which had the highest or second-highest premiums of 33 companies selling coverage in several Dallas-area ZIP codes where rates were examined by The Dallas Morning News. State Farm, the largest property insurer in Texas, is charging those rates even as it refunds $352 million to its customers for past overcharges, under a settlement with the state. Boeing Faces Lawsuit Over Fatal Injuries by Airbag |
The family of a man who died in Everett, Washington has filed a lawsuit against his employer, airplane manufacturer Boeing. The man was killed in November 2014 when an airbag inflator discharged during installation on an aircraft, hitting him in the face and causing fatal head injuries. The man was rushed to the hospital after the incident and died a few weeks later.
