H-E-B Recalls Dairy Products

Grocery store chain H-E-B has issued a recall of store brand cottage cheese, dips, yogurt and sour cream sold between June 18 and July 26. The products, sold in 8-ounce, 16-ounce, 24-ounce and 32-ounce sizes, were recalled due to the possible presence of "foreign material." Government, Vets Reach Settlement in Over Benefits

More than a thousand Iraq and Afghanistan veterans with post-traumatic stress disorder would be given lifetime disability retirement benefits such as military health insurance under the terms of a settlement reached between the government and the veterans. Attorneys for the veterans, the Justice Department and the military jointly filed a motion on Thursday that spelled out the terms. The settlement must be approved by a judge to be final. It also affects another thousand veterans who already had lifetime retirement benefits, but would receive a higher disability rating from the military. The settlement stems from a 2008 class action lawsuit filed in the U.S. Court of Federal Claims in Washington by veterans unable to serve, at least in part, because of the anxiety disorder who said they were illegally denied benefits.  Associated Press, The Washington Post  07/29/2011

Bank of America Faces New Suit Over Countrywide

The subprime litigation nightmare that Bank of America Corp. inherited with its acquisition of Countrywide Financial Corp. was compounded Thursday when 16 investors — including the giant California Public Employees' Retirement System — brought a new lawsuit alleging that Countrywide misled them about the risks it was taking. The plaintiffs in the latest suit were among nearly three dozen investors who opted out of a separate $624-million settlement that Bank of America reached with shareholders last year. The plaintiffs, which also include money manager BlackRock Inc. and several T. Rowe Price mutual funds, allege that Countrywide intentionally downplayed its shift from a traditional to a high-risk lender.  Walter Hamilton & Stuart Pfeifer, LA Times  07/29/2011

New Haven FD Settles Reverse Discrimination Lawsuit

The city of New Haven has agreed to a $2 million settlement in a discrimination lawsuit filed by a group of white firefighters. The suit was filed in 2004 after the department scrapped a civil service exam in which only white firefighters scored high enough for promotions. By scrapping the results, more than half of the plaintiffs were denied promotions. As part of the settlement, the department reinstated the test scores and promoted 14 of the 20 plaintiffs.  Edmund H. Mahony, The Hartford Courant  07/28/2011

Suit Against Rick Perry, Prayer Day, Tossed Out

A federal judge in Houston this week tossed out a lawsuit filed against Texas Governor Rick Perry and his participation in the Aug. 6 prayer day in Houston. The judge said the atheist group who filed the suit had no standing to sue because "they are not harmed by Perry's actions." The judge said the plaintiffs have other ways to show their disapproval, including not attending the event, not praying and voting.  Joe Holley, Houston Chronicle  07/28/2011

Pittsburgh Port Authority Settles Harassment Suit

The Port Authority in Pittsburgh has reached an undisclosed settlement with an employee who claimed she was racially harassed at work. According to the suit, the African-American woman claimed "that someone at the transit service's East Liberty garage placed a black baby doll with a handwritten racial slur in front of her locker."  Staff Report, Pittsburgh Post-Gazette  07/29/2011

NJ Residents Frustrated Over 9/11 Victims Fund

The head of a fund for people injured in the Sept. 11 attacks on the World Trade Center explained how they could be eligible for compensation but got an earful from those who said the limitations are too restrictive and seem engineered by detached lawmakers. Sheila Birnbaum, charged with administering the fund, addressed first responders and others at a town hall meeting in City Hall two days after a federal review found insufficient evidence linking cancer to Sept. 11 to warrant adding cancer to the list of conditions covered. The debate over whether cancer and other illnesses should merit compensation from the fund underscores the delicate and emotionally charged issue of how victims prove their injuries were caused by the 2001 attacks.  Associated Press, Yahoo News  07/29/2011
