Jury Awards $150M in Punitive Damages in Testosterone Case

Federal jurors in Chicago say the pharmaceutical company AbbVie should pay $150 million to an Oregon man for misrepresenting the risks of a low testosterone treatment. The Chicago Tribune reports that the jury arrived at the figure for punitive damages after a three week trial stemming from Jesse Mitchell's claims the AndroGel drug caused his heart attack in 2012 when he was just 49. But jurors didn't find the company was negligent or that AndroGel lacked appropriate warnings. An AbbVie spokeswoman said the company expected "the punitive damage award will not stand." Thousands of related lawsuits have been filed and Mitchell's case was viewed as a bellwether.

A fired Fox News executive has filed a lawsuit alleging that the network used him as a "scapegoat" in a sexual harassment investigation. The lawsuit was filed against Twenty-First Century Fox America by Francisco Cortes who alleges that the network purposefully commented on settlement of harassment claims against him by a former Fox contributor. The complaint states that Fox made the plaintiff a "scapegoat" in order to "demonstrate that it aggressively handles sexual harassment complaints." The plaintiff is seeking $48 million in damages against the network and two individuals.

Country Singer Rich O'Toole Sues Uber for Crash

Singer Rich O'Toole, who was seriously injured in a crash while taking an Uber in Amarillo, has sued Uber and its driver for negligence after the car in which he was riding in was hit by another vehicle. O'Toole took a Uber before a performance he was scheduled to give in Amarillo. The Uber driver got lost, stopped his vehicle in the middle of the highway, and got hit from behind, according to the lawsuit. O'Toole broke his neck, underwent emergency surgery and narrowly escaped permanent paralysis. Uber maintains that the driver was an independent contractor, according to the lawsuit, but O'Toole argued the driver was an employee of Uber.

Dallas Couple Files Lawsuit Against Body Shop that Glued Their Car Roof
spacer image
A seriously injured Dallas couple is seeking more than $1M from a body shop that did shoddy work on their Honda, according to a lawsuit. Matthew Seebachan, 33, and his wife Marcia were nearly killed on Dec. 21, 2013, when their 2010 Honda Fit was struck by another car, according to court documents filed in Dallas County District Court. When the couple had purchased the car, the CarFax report did not reflect work done on its roof by the John Eagle Collision Center. The roof of the car was repaired with glue instead of being welded, said body shop director John Boyce in a deposition. The car's previous owner had taken it to John Eagle in July 2012 to get its roof repaired following a hail storm.
