Thousands of Children Under 5 Injured by Exposure Personal Care Products
spacer image
Some 64,686 children under 5 have been treated at U.S. emergency rooms during a 15-year period for an injury caused by exposure to perfume, nail polish, makeup and other personal care products. The injury totals from 2002 to 2016 were reported in the journal Clinical Pediatrics, and were based on U.S. Consumer Product Safety Commission data. Nearly all injuries (99 percent) occur at home, and children younger than 2 are hurt more often than 2- to 4-year-olds. The most common diagnosis is poisoning (86 percent of injuries), usually caused by children inhaling or swallowing a personal care or cosmetic product, but sometimes chemical burns result from childrenâ??s contact with a product (14 percent of injuries).

Utah Supreme Court Justice Deno Himonas wrote the decision rejecting a 2010 law requiring a person who wants to sue a medical professional to get an affidavit from a health care provider saying the claims are valid if a state panel has already decided the claims lack merit. The Supreme Court ruled unanimously that the law stepped on the judicial branch, which should have the final say on medical malpractice suits.

Insurers Face Risk of Child Sex-Abuse Claims

State laws expanding the statute of limitations for child sexual-abuse claims pose a growing financial risk to insurance companies, said ratings firm A.M. Best. Insurers that have written liability insurance policies for schools, religious institutions or municipal entities will likely need to increase the reserves they set aside to pay for claims, A.M. Best said in its new report, which will be released Monday. Those types of entities are at risk of increased claims alleging they were negligent in hiring or supervising alleged abusers. The report compares child sexual-abuse claims to asbestos liability because the claims can affect decades-old insurance policies and the settlement amounts can be difficult to predict.
