Investigation: A Pass to Poison |

A Texas Tribune analysis of self-reported industry data shows that thousands of rogue releases occur at Texas industrial sites each year. They are known generically as “emissions events”— a term that refers to both malfunctions or “upsets” and unplanned “maintenance, start-up or shutdown” activities. Whether they are truly unavoidable is a point of dispute. Last year, there were 3,723 of these emissions events at 774 industrial sites across the state, according to the Tribune's analysis. That's more than 10 per day on average.

Single Slur Can Establish Workplace Harassment, 3rd Circuit Rules |

A single racial slur in the workplace may be enough to establish a lawsuit for harassment, the U.S. Court of Appeals for the Third Circuit ruled. Clarifying muddled precedent about what needs to be alleged for workplace discrimination claims to survive the pleadings stage, a three-judge panel of the circuit determined plaintiffs need to show that harassment is “severe or pervasive,” rather than “severe and pervasive.” The decision in Castleberry v. STI Group reversed a ruling from the U.S. District Court for the Middle District of Pennsylvania, which had dismissed the claims.

Amazon Settles Job Applicant's Background Check Suit |

A man denied a job at Amazon.com based on an allegedly inaccurate background check has reached a settlement with the online retailer to resolve his proposed class action alleging violations of the Fair Credit Reporting Act, according to a Thursday filing in New Jersey federal court. Theo Feldstein filed a joint stipulation with Amazon explaining that they have reached a deal bringing an end to his suit claiming the retailer withdrew its offer for a position as a fulfillment associate at a New Jersey facility.

Adultery Site Ashley Madison to Pay $11.2 Million for User Data Breach |

The owner of the Ashley Madison adultery website said on Friday it will pay $11.2 million to settle U.S. litigation brought on behalf of roughly 37 million users whose personal details were exposed in a July 2015 data breach. Ruby Corp, formerly known as Avid Life Media Inc., denied wrongdoing in agreeing to the preliminary class-action settlement, which requires approval by a federal judge in St. Louis.

Judge Allows Family of Teen Lost at Sea to File Suit |

A federal judge has ruled that the parents of one teen who went missing at sea can file suit against the family of the other teen who disappeared with him. The families of the two boys who went missing off the Jupiter Inlet in Florida in July 2015 have been largely at odds since their sons went missing. U. S. District Judge William P. Dimitrouleas has lifted an injunction preventing one family from filing suit against the other over a maritime law called the Limitation of Vessel Owner's Liability Act.

Man Paralyzed During 'Bubble Soccer' Awarded $45M |

A Missouri man who was paralyzed while playing "bubble soccer" has been awarded $45 million. The plaintiff was awarded the large sum after a Cole County Judge found that an Ashland business was liable for injuries that left the plaintiff a quadriplegic. Following an injury while playing "bubble soccer," the plaintiff was diagnosed with a fracture and spinal cord injury that left him paralyzed. He filed suit against Knockerball Mid-MO alleging that the company was responsible for his injury.
