Insurance Co. Hit with Doctors' Suit Over Coverage

A group of California doctors has filed a lawsuit against insurance provider Aetna Inc., accusing the company of denying patients coverage they already paid for. According to the suit, Aetna has refused to cover out-of-network doctors despite patients purchasing a policy "giving them to the right to choose providers." The suit is seeking compensations for both patients and physicians and unspecified punitive damages.  Staff Report, Reuters  07/03/2012

NFL Players File Suit over League Appeals Process

The NFL Player's Association has filed a lawsuit against the league and Commissioner Roger Goodell, claiming the league's appeals process, which is also governed by Goodell, is "fundamentally unfair." The suit comes on the heels of Goodell's ruling to uphold the suspension of four New Orleans Saints players over a pay-for-play scandal. The lawsuit says players are entitled to a "transparent, credible and fair arbitration process," and that appeals should go through an impartial arbitrator, not Goodell.  Ryan Jones, New Orleans Times-Picayune  07/05/2012

Fitness Club Settles Suit with Gay Family

A fitness club in Roanoke, Va., has altered its membership policies after a gay man filed a lawsuit claiming his family membership was revoked when the club found out he was in a same-sex marriage. In the lawsuit, the plaintiff claimed he, his partner and their two-year-old son were denied access because they didn't "meet club official's definition of a family."  Wire Report, Richmond Times-Dispatch  07/05/2012

Suit: JP Morgan Chase Responsible for Man's Death

JP Morgan Chase has been named in a lawsuit over the sudden death of a 79-year-old Texas man. According to the lawsuit, a JP Morgan Chase banker instructed the man and his wife to enter into a program that offered a lower refinancing rate on their home. A few months later, however, they began receiving foreclosure notices and late-fee penalties on their home, prompting the man's death from a stress-induced heart attack, the suit claims. Suit over Toddler's Death at Staples Center Dismissed

A Superior Court judge in California has dismissed a wrongful death lawsuit against the owners of Staples Center and the arena operator. The lawsuit was filed after a toddler fell to his death from a luxury box during a 2010 Lakers game. The judge ruled that it was "not foreseeable" that the child's parents would place him in an area where he could easily climb over the glass barrier and fall out of the box.  Matt Stevens and Andrew Blankstein, LA Times  07/03/2012

Retailers Sue Pfizer over Absence of Generic Lipitor Drug

A group of U.S. retailers have filed an anti-trust lawsuit against drug maker Pfizer Inc. and Ranbaxy Laboratories Ltd over delays of generic versions of the cholesterol drug Lipitor. The lawsuit claims the companies conspired to keep generic drugs off the market by using price-fixing and sham litigation. Because of this, retailers have been forced to pay "hundreds of millions of dollars more" for Lipitor than they would have paid for a generic version.  Jonathan Stempel, Reuters  07/05/2012

Murder of Wisconsin Boy Brings Lawsuit

The fatal shooting of a 13-year-old Milwaukee boy has prompted a lawsuit against the 75-year-old man who shot him. The lawsuit claims John Spooner shot the boy in the chest after accusing him of stealing his guns. The suit is also seeking an injunction preventing Spooner from disposing of his assets. Spooner is being held on first-degree intentional homicide charges.  Wire Report, San Francisco Chronicle  07/05/2012
