Trucker Wins Hollow Victory in Workers' Comp Case

Last October, Juan Boston received two letters at his Humble home telling the out-of-work trucker something he already knew: After he injured his back in 2012, his insurance company should have recorded it properly. Had New Hampshire Insurance Company documented his injury as state law requires, Boston might not have found himself on the losing end of a benefits dispute. The Texas Division of Workers Compensation is now promising to â??take appropriate action on this matterâ?? against the insurance company for its mistake, it wrote to Boston. But whatever the state does now â?? whether a warning, fine or anything else â?? wonâ??t help the 40-year-old pay the bills that have piled up in the years since McLane Foodservice Inc. fired him once he was too hurt to work. Though Texas law says workersâ?? comp providers are liable for reported injuries they fail to document, state regulators say their hands are tied in cases like Bostonâ??s. They have no plans to order New Hampshire Insurance, an AIG affiliate, to compensate Boston for the herniated discs and other spinal damage that he attributes to hoisting 40-plus pound boxes at work.

Lawsuit: Wal-Mart Sold Ammo Used in 3 Killings

Families of three people killed in Pennsylvania last year are suing Wal-Mart, alleging the retail giant sold ammunition used in the slayings to a man who was underage and drunk. Wal-Mart employees in Easton were negligent in selling .38-caliber ammunition to 20-year-old Robert Jordain, failing to ensure he was at least 21 as required by law, the suit said.

Toddler's Death Sparks Second Lawsuit Over Ikea Dressers

The parents of a Washington state toddler who died after being pinned beneath a toppled Ikea dresser have filed a wrongful-death lawsuit against the furniture giant, claiming Ikea sold the dresser despite knowing it was unstable. Filed in Philadelphia Common Pleas Court, the lawsuit by the parents of 2-year-old Camden Ellis of Bothell is the second in less than a year against Ikea stemming from a fatal tip-over of a Malm dresser. A similar suit was filed by the mother of Curren Collas, a West Chester 2-year-old, who died in February 2014 when a dresser tipped onto him.
