ABA is Trying to Address a Shortage of Trial Lawyers

After a slow decades-long decline, only about two percent of civil cases, such as divorce, product liability and family squabbles over wills, now make it to trial. Itâ??s usually cheaper, faster and a whole lot less risky to settle out of court. But that small number, plus the preference for experienced trial attorneys, means junior lawyers have few chances to learn how to argue a case in front of a jury. The problem has gotten so acute that when the American Bar Association holds its annual meeting this month, there will be something new on the agenda: a proposal to get more junior lawyers into the courtroom.

Male Student Sues UT-Austin President Fenves Over Sexual Assault Suspension
A University of Texas at Austin student said he was unfairly suspended from the university after President Gregory Fenves intervened in his sexual assault case. In a lawsuit filed Monday, the student accused Fenves of unfairly intervening in an effort to take a hard-line stance on campus sexual assault, fearing that UT-Austin would "suffer the same public relations disaster that occurred at nearby Baylor University" if administrators did not appear to take the crime seriously. An initial review had sided with the male student. Fenves sided with the female student on appeal.

Mom Files $4.2M Suit Against Woman in Texting Suicide Case

The mother of a teenager who killed himself has filed a wrongful death lawsuit against a Massachusetts woman convicted of manslaughter for encouraging him to take his own life. Lynn Roy is seeking $4.2 million in lost future wages for her son Conrad Roy III. The lawsuit was filed against Michelle Carter last month in Norfolk Superior Court on behalf of her sonâ??s estate.

Settlement Reached in Tracy Morgan, Wal-Mart Crash Lawsuit

A settlement has been reached in a lawsuit over the 2014 crash involving comedian Tracy Morgan. Wal-Mart, whose truck was involved in the crash, has settled a lawsuit by a two insurers that sought to avoid covering the crash. On Monday, U.S. District Judge Freda Wolfson in Trenton, New Jersey ordered the claims by Ohio Casualty Insurance and Liberty Insurance Underwriters against Wal-Mart to be dismissed. The crash on June 7, 2014 resulted in the death of comedian James McNair and serious injuries to Morgan and other passengers. While the settlement has not been disclosed, court documents suggest that it may have been over $90 million.

Former Boy Scouts Overcome Statute of Limitations in Sex Abuse Case

Three alleged victims of sexual abuse by a Boy Scout leader have overcome a challenge seeking the dismissal of their case due to statute of limitations. The former Boy Scouts filed suit alleging that they had suffered sexual abuse by a former leader when they were children in the 1990s. On July 31, Bergen County Superior Court Judge John O'Dwyer ruled that the case could continue as the plaintiffs filed suit within two years of discovering that their emotional injuries were linked to alleged abuse by the Scout leader. The 49-year-old former leader was sentenced in June to seven years for possession of child pornography.

Two Doctors Killed in South Boston Penthouse, Families File Suit

The families of two doctors who were killed in South Boston have filed wrongful-death lawsuits against the owners of the building were the two were killed. The doctors were killed in their South Boston penthouse apartment building when a gunman entered their complex. According to the complaints, one of the victims told a friend about the gunman via text message. The friend notified the apartment security, but by the time guards investigated the incident, the two doctors had already been murdered, the lawsuits state. Named as defendants in the lawsuits are the Highbridge Concierge, Bayberry Management, Court Square Press Building Condominium Trust and Palladion Services. The wrongful-death lawsuits ask for a trial by jury.

Settlement Reached in Lawsuit Over Clemson Fraternity Pledge's Death

A settlement has been reached between Clemson University and the family of a fraternity pledge who was killed on Lake Hartwell. The family of the 19-year-old filed suit against the university, the Sigma Phi Epsilon fraternity and several fraternity members over the young man's death. The student was found dead near the S.C. 93 bridge hours after going on a run with about 30 members of the fraternity on Sept. 22, 2014. His family filed a $25 million wrongful death lawsuit and a survival action in March 2015, which were consolidated this year. While the case has been settled, the terms of the settlement have remained confidential.
