Live Webinar (9/27/18): The New Federal Tax Law: Implications are Surprisingly Bad for Plaintiffs
Robert W. Wood will discuss the new federal tax law and its implications for plaintiffs and their lawyers. For many types of cases, the lack of tax deductions for legal fees may be catastrophic. Plaintiffs in many types of litigation will feel the full force of paying taxes on their gross recoveries, with no deduction for their legal fees and costs. Topics discussed will include: changes in how taxes on attorney fees are determined, and the elimination of the 'below-the-line deduction' for legal fees; the numerous types of cases impacted by the changes, including insurance bad faith, employment, whistle blower, sexual harassment, intentional emotional distress, and punitive damages; and, the implications of the tax laws on settlement negotiations. In September 2016, William Foley took a drag on his vaping device and nearly burned down his house in La Miranda, California. Foley's home insurer, State Farm, paid Foley more than $400,000 for repairs and related expenses. The insurer contends the fire was caused by a defective LG battery in Foley's vaping device. Last month, State Farm lawyers filed a complaint in Los Angeles Superior Court, seeking to recoup the money it paid on Foley's claim. State Farm is also suing Amazon, which it blames for selling Foley the allegedly defective batteries in his vaping device.

Court Tosses Trump Administration Delay of Chemical Disaster Rules

The D.C. Circuit Court of Appeals ruled Friday that the Environmental Protection Agency can no longer delay a new set of regulations designed to prevent chemical disasters. The Chemical Disaster Rule, stemming from industrial accidents like the 2013 West Fertilizer explosion in Texas, requires companies to obtain outside audits and share more information with first responders and emergency planners. It also requires industrial facilities to publish chemical inventories and disclose the root causes of chemical incidents at their facilities.

A Missouri mother has filed a wrongful death lawsuit alleging that her daughter committed suicide after being bullied at school for years. The lawsuit was filed against the Hallsville School District, along with the district's superintendent, former middle school principal and assistant principal.
