Cleveland Browns Settle Suit with Former Player

The Cleveland Browns have settled a lawsuit with former player LeCharles Bentley over a career-ending staph infection he contracted during rehab at a team facility in 2010. Bentley claimed in his suit that the team failed to warn him that other players had contracted infections from the same facility over a five-year period prior to his rehab. Bumbo Recalls 4M Baby Seats

Bumbo International Trust is voluntarily recalling about 4 million Bumbo Baby Seats after scores of injuries, including skull fractures, the South African company and the Consumer Product Safety Commission (CPSC) said on Wednesday. Since a 2007 recall, at least 50 incidents have been reported in which babies fell while the molded-foam seat was on a raised surface. Nineteen of the incidents included skull fractures, the company and the CPSC said in a statement.  Reuters, Chicago Tribune  08/15/2012

Class-Action Suit Targets Camera Tickets in Maryland

A class-action lawsuit has been filed against the city of Riverdale Park, Md., claiming tens of thousands of tickets issued by speed cameras are invalid. The suit claims the tickets have not been approved by a police officer, which is a violation of state law. Two civilian employees allegedly used a police officer's log in to approve the tickets without an officer reviewing them.  Matt Zapotosky, The Washington Post  08/13/2012

Dallas Court of Appeals: Torts

The trial court granted judgment for the defendants, the appellees, in this defamation suit. When the burden of proof shifted to appellants, they did not raise a fact issue regarding whether appellees acted in reckless disregard for the truth or falsity of the statements made in the article and the blog posts at issue, as required to defeat summary judgment on the issue of actual malice. Suit Comes After Jet Ski Death in Hawaii

The death of a 16-year-old California girl in a watercraft crash in Honolulu has prompted a lawsuit against the man responsible for the crash and a local jet ski rental company. Police say the man was "standing on his watercraft" before he struck the victim, was traveling at high speeds and not watching where he was going. The defendant has been charged with third-degree negligent homicide.  Wire Report, San Jose Mercury News  08/15/2012

Settlement Reached over 'Defective' F-22 Raptor

A group of defense contractors have agreed to settle a lawsuit with the widow of a pilot who died in an F-22 crash in 2010. In her lawsuit, the woman claimed the F-22 stealth fighter was "unreasonably defective," and led to her husband's death. Among the claims, the suit said the jet's oxygen-supply system did not give enough air to the pilot. The terms of the suit were undisclosed.  Hugh Lessig, The Daily Press  08/14/2012
