Suit Over Wrong HIV Diagnosis Settled

spacer image

A seven-year court battle in the District over an HIV misdiagnosis ended this week when the Whitman-Walker Clinic quietly settled a $20 million lawsuit by a former patient who was mistakenly told he had the virus. In 2005, Terry Hedgepeth, 52, sued Whitman-Walker because it had mistakenly told him five years earlier that he was HIV-positive. Since then, Hedgepeth, his attorney, Whitman-Walker, and judges in D.C. Superior Court and the D.C. Court of Appeals had been embroiled in legal wrangling. On Tuesday, just a week before the case was to go to trial in D.C. Superior Court, an agreement was reached. Details of the settlement weren’t disclosed.  Keith L. Alexander, The Washington Post  08/13/2012

Thousands File Claims After Chevron Refinery Fire

spacer image

Several thousand Richmond, CA residents have filed legal claims against Chevron Corp., seeking compensation for a refinery fire that fouled the region's air for hours and sent more than 4,000 people to seek medical care for breathing problems and irritated eyes. Hundreds of residents showed up at a makeshift claim center in Richmond on Friday, and many more submitted claims throughout the week by calling a special hotline Chevron established after Monday's explosion and fire. The company said a total of about 3,800 people had submitted claims through Friday afternoon.  PAUL ELIAS, AP, Miami Herald  08/13/2012

37,000 Chevy Impala Police Cruisers Recalled

spacer image

Chevrolet will recall about 37,000 Impala police sedans in the United States and Canada due to problems with the suspension. The company said the front lower control arm can fracture and separate, causing changes in handing and steering. There have been no reported accidents caused by the problem, the company said.  Doug Stewart, The Hartford Courant  08/10/2012

Mercedes Recalls Floor Mats From Some ML-Class Cars

spacer image

Mercedes-Benz is recalling all-season accessory floor mats sold in model year 2012 and 2013 ML-Class vehicles because they could cause the car’s gas pedal to get stuck. Mercedes said Saturday that the mats may not conform to the contours of the car’s floor. As a result, the gas pedal may not fully retract after the driver stops applying pressure, and the car may not slow down as expected. The company is advising ML-Class owners to remove the accessory floor mats.  Associated Press, The Washington Post  08/13/2012

Woman Seeking Lawsuit After Face Ripped Off by Chimp

spacer image

The Connecticut Claims Commissioner will hold a hearing next month to decide if a local woman whose face was ripped off by a chimpanzee in 2009 can sue the state's Department of Energy and Environmental Protection. The woman, who says she is seeking $150 million in damages, claims the department knew the monkey was a "menace" for years, but did nothing. State officials, however, have said they did not have the authority to remove the chimp from the private home.  Corky Siemaszko , New York Daily News  08/10/2012

Are You Worth More Dead Than Alive?

spacer image

Selling your life and selling a house have more in common than you’d think. The seller puts a listing on the market. Prospective buyers do research and get inspections; there are offers and counteroffers until the seller accepts a bid. The seller doesn’t literally peddle his own life, of course, but his life-insurance policy. The distinction is in many ways moot, however, as the sales value is inextricably linked to a cold-eyed estimation of how much longer the seller has to live.  JAMES VLAHOS, The New York Times  08/13/2012

Patricia Kilday Hart: Texas Takes Tort Reform Too Far

spacer image

In Texas, we're learning what happens when you can't turn to a lawyer for help. Two strong forces are making it nearly impossible to seek redress for injury in state courts: sweeping tort reform laws and a Texas Supreme Court with an activist conservative bent. The results aren't pretty.  Patricia Kilday Hart (columnist), Houston Chronicle  08/13/2012

A Florida woman has filed a lawsuit against a child day-care center in Sunrise, Fla., over the death of her 4-year-old son, who was left outside in a scorching SUV in early August. The van driver and day-care officials "forgot they had left [the boy] in the SUV" for over two hours before finding his body. The lawsuit is seeking unspecified damages.  Julie K.
