Walgreens Dumping Waste Illegally, Counties Argue

More than thirty counties in California have asked a state judge to force retail giant Walgreens to stop disposing of hazardous waste in local landfills. In the complaint, the counties argue that Walgreens has been illegally dumping "pharmaceuticals, automotive products and solvents, to local landfills for at least six years." The suit says the dumping is an attempt by Walgreens to circumvent environmental laws and cut costs.  Paul T. Rosynsky, San Jose Mercury News  08/07/2012

Rick's Cabaret Sued in Teen's Death

A family filed a civil lawsuit against Rick's Cabaret for the wrongful death of their daughter, who was killed in a drunk driving accident. According to the lawsuit, the company’s policy encourages workers to sell as many alcoholic beverages as possible. Emily Jones' family said it's that policy that contributed to Emily's death on March 30, 2011. The lawsuit claims Ramirez had been drinking at Rick’s Cabaret that night. He was driving more than 100 mph when he smashed into Jones’ truck, said investigators. According to the lawsuit, Rick's employees continued to serve Ramirez drinks even though he was already intoxicated. The suit claims Ramirez was removed from the club after he refused to pay for dances and/or services provided by Rick's entertainment staff.  Staff, Click2Houston  08/07/2012

UT Scientist Draws Link Between Injection Waste Wells and Earthquakes

Using newly available technology, a University of Texas seismologist tracking small earthquakes in the Barnett Shale play area of North Texas has found a correlation between geological disturbances and the sort of injection wells that are associated with hydraulic fracturing, according to research appearing this week in the journal Proceedings of the National Academy of Sciences.  Asher Price, Austin American Statesman  08/07/2012

The City of San Antonio, acting by and through CPS Energy, appeals the trial court's denial of its plea to the jurisdiction in this suit by Wheelabrator Air Pollution Control Inc. The governmental/proprietary distinction employed in the Texas Tort Claims Act does not apply in a contractual or quasi-contractual setting to determine whether a municipality is immune from suit. The trial court's denial is reversed and rendered. City of San Antonio v.
