A Severely Injured Man Had to Give up His Entire Settlement, Court Said That Was OK | | Badly injured when a young driver lost control of her car and caused a deadly multiple accident, U.S. Airways mechanic supervisor James McCutchen suffered more than $1 million in damages.But he could only collect $110,000 from the at-fault driver and other policies, which shrunk to $66,000 after he paid his attorney’s fee and other costs. Then the airline’s health insurance plan demanded that he repay the $66,800 it had spent on his medical care. He would end up $800 in the hole. A federal appeals court ruled for McCutchen, but the U.S. Supreme Court in 2013 reversed, siding with U.S. Airways. In its ruling, the court said as long as a health plan’s contract with employees specifies that it is to be reimbursed for medical costs in such situations, it has a legal right to collect =E2=80=93 whether it's fair to the employee or not. Hundreds Sue Engineering Firm over Harvey Flooding in Fort Bend Levee District | | Hundreds of Fort Bend County residents sued a local engineering firm Wednesday alleging the company acted negligently in designing a stormwater management system for a community that flooded during Hurricane Harvey. The lawsuit filed against Costello, Inc. in state district court focuses on work the engineering firm performed for a Fort Bend Levee Improvement District created more than a decade ago. Gov’t: Goodyear Tires May Have Caused 95 Deaths or Injuries | | NHTSA says it has received allegations that defective Goodyear motor-home tires caused crashes that killed or injured 95 people during the past two decades. The allegations were revealed in an information-seeking letter that was sent to Goodyear by the agency which began investigating whether the company’s G159 tires are unsafe last year after a judge ordered the release of Goodyear data that had been sealed under court orders and settlement agreements. Lawsuits and safety advocates allege the tires were designed for delivery trucks and not for recreational vehicles that travel at highway speeds. West Virginia Mine Explosion Subject of Lawsuit Against Federal Officials | | A lawsuit has been filed alleging that federal officials did not do enough to prevent an explosion at the Upper Big Branch Mine in West Virginia. The lawsuit was filed in the U.S. District Court’s Southern District of West Virginia over an incident that killed 29 miners at the Upper Big Branch Mine, in Raleigh County. Named as plaintiff in the lawsuit is the wife of one of the miners killed in the explosion. The defendants, the Mine Safety and Health Administration and the United States, failed to prevent the fatal incident and was negligent in its enforcement of safety measures at the mine, says the complaint.
