Midwives Agree To $5M Deal in Birthing Center Lawsuit

Two Idaho midwives have agreed to a $5 million settlement with a couple who sued them for medical malpractice after their baby suffered permanent brain damage, an attorney said. Coleen Goodwin and her daughter, Jerusha Goodwin, reached the agreement to avoid a jury trial. How much money will ever be paid is unclear; the Goodwins, like all other Idaho midwife practices, do not carry costly malpractice insurance and are planning to seek bankruptcy protection.  John Miller, The Insurance Journal  04/26/2012

Suit Challenges Expulsion Over Facebook Posts

A lawsuit has been filed against a north Indiana school district for the expulsion of three eighth-grade girls over comments they made on Facebook. The students were expelled over a conversation on Facebook in which they discussed which classmates they would kill if given the chance. The suit, however, claims that the conversation was "teenage banter" and should not have been taken seriously.  Deanese Williams-Harris, Chicago Tribune  04/26/2012

Suit: Woman Fired for Undergoing Fertility Treatment

A former teacher at an Indiana catholic school has filed a lawsuit against the Indiana Archdiocese over her firing for undergoing in vitro fertilization. When she requested time off to undergo the fertility treatment, she was told "in vitro fertilization ... is an intrinsic evil, which means that no circumstances can justify it" and was called a "grave, immoral sinner." The suit is seeking unspecified damages.  Larry Mcshane, New York Daily News  04/25/2012

Conference on Avoidable Care: Malpractice Lawsuits Not the Primary Culprit

spacer image

At a conference attended by dozens of doctors, the message of one panel discussion might have seemed out of place: Medical malpractice is not a primary culprit in the rising cost of medical care. The speakers and most audience members who approached the microphones during a panel near the start of the two-day Avoiding Avoidable Care conference, hosted in Cambridge by the Lown Cardiovascular Research Foundation and the New America Foundation, seemed to agree.  Chelsea Conaboy, Bloomberg  04/26/2012

Death of South Bend Boy Prompts Lawsuit

spacer image

The death of a 12-year-old South Bend boy has prompted a wrongful death lawsuit against the 14-year-old boy who was driving the car that killed him. In the suit, the victim's parents say the teen was driving without a license and at a high rate of speed when he caused the crash. The family of the victim said they filed the lawsuit because "they've not been able to find out how the 14-year-old ended up driving the SUV."  Staff Report, Indianapolis Star  04/25/2012
