The man was attending a game between the Braves and the Yankees last August when he lost his footing and fell 40 feet. The lawsuit was filed on Tuesday against the Atlanta Braves and Major League Baseball alleging that the railing over which the man fell was inadequate. The lawsuit further alleges that the defendants knew the railings were too short and unsafe but failed to pay to replace them. The lawsuit was filed by the man's mother and boyfriend eighteen months after the car crash took place. According to the lawsuit, Lyft has failed to take financial responsibility for the crash that authorities determined was the Lyft driver's fault, despite the ride-sharing company's $1 million insurance liability policy. The complaint further alleges that, in addition to not providing compensation, the company has not offered any condolences to the family of the 24-year-old victim. The deal includes "substantial compensation" for owners of cars powered by two-liter "clean diesel" engines that were fitted with software to cheat emissions tests, U.S. District Judge Charles Breyer said in a hearing from a courtroom in San Francisco. Consumers will be allowed to sell their vehicles back to Volkswagen or get repairs, the judge said. But financial details of the offer, which is still being finalized, were not disclosed.
