While the judge did toss out claims of negligence against the theater owner, he did allow claims to proceed under the state's Premises Liability Act. The judge also stated that wrongful death claims could proceed as they were related to liability under the act. Tom McGhee, Denver Post 04/17/2013 | Read Article: Denver Post | Suit: Study Put Infants at Risk for Health Issues | | Five groups of parents in Birmingham, Ala., have filed suit against the University of Alabama at Birmingham, alleging a study conducted on infants put their children at risk for severe health issues. The suit claims the study, which was to determine the best level of oxygen to sustain the tiny infants, put the child at risk of permanent brain damage and respiratory disease. The suit accuses those in charge of the study of negligence and failure to properly inform parents of the risks their children faced. Cases of campylobacter grew by 14 percent over the last five years, a government study found. The Centers for Disease Control and Prevention report was based on foodborne infections in only 10 states — about 15 percent of the American population. But it is seen as a good indicator of food poisoning trends — the CDC refers to it as "the nation's annual food safety report card." The EPA's Office of Inspector General said in a report that the studies are necessary to determine whether expensive, ongoing cleanup efforts are working in the town of Libby.
