Countrywide to Pay $500 Million Settlement

Countrywide, a unit of Bank of America Corp., has agreed to settle a class action suit in Los Angeles over residential mortgage-backed securities for $500 million. The suit was led by the Iowa Public Retirement System and sought damages for “downgraded Countrywide mortgage-backed securities after the 2007 subprime collapse.” The Los Angeles settlement will not affect the distributions for the previously settled $8.5 million between Bank of America and “institutional investors in Countrywide mortgage-backed securities.”

Galveston County Residents File Lawsuit Over BP Gas Leak

A second lawsuit has been filed against BP after a 2011 gas leak at their former Texas City Refinery. 474 Galveston County residents are seeking $1B in damages. The suit alleges that BP intentionally mislead “the public about the seriousness of a Nov. 10, 2011, leak that continued for several weeks.” The leak released methyl mercaptan and several other pollutants, The lawsuit contends that BP knew their monitors were incapable of detecting methyl mercaptan, but released a statement that “the monitoring had failed to pick up any detectable levels of” the chemical.

Suit Filed Over Alleged Home Insurance Scam

A Kentucky resident has filed a federal suit against State Automobile Mutual Insurance Co. contending that the increased insurance “limit of liability” on his homeowner insurance is a scam. His homeowner’s insurance policy was raised to $503,000 in limit of liability, but the home is only valued at $239,000. The suit alleges that clients “are paying more in premiums but get no more coverage” and that State Auto is raising the limit of liability to increase profits after a tough financial year in 2011. The suit is also seeking class action status.

Jury Decides in Favor of Johnson & Johnson in IL Hip Implant Case

A jury in an Illinois state court decided against the plaintiff in case that alleged the Illinois woman had been harmed by a metal-on-metal hip implant. The case alleged that the hip implant had shed metal into the plaintiff’s body “poisoning tissue and sending metal ions into her blood stream.” Almost 11,000 cases have been filed against DePuy Orthopaedics, a unit of Johnson & Johnson, over the ASR XL implant that was recalled in August 2010. This is the second case to go to trial in the U.S.

Wrongful Death Lawsuit Filed After KY Vehicle Accident

Highway Star, a Michigan-based trucking company, and driver Ibrahim Fetic have been named in a wrongful-death lawsuit after the deaths of four people in a rear-end collision. A Wisconsin family of six was traveling from Florida on Interstate 65 when they were rear-ended by a tractor-trailer. Four of the individuals were “trapped inside the vehicle while it burned, resulting in their deaths.” The lawsuit alleges that the driver was “maintaining two sets of driver log books in an effort to hide information from regulatory agencies” and had “had driven his truck in excess of the allowed number of hours, which resulted in driver fatigue.”
