Doctor Confesses: I Lied to Protect Colleague in Malpractice Suit |
Thereâ??s no way to tell how often doctors to lie to protect their colleagues, but ProPublica has found that patients are frequently not told the truth when they are harmed. Studies also show that many physicians do not have a favorable view of informing patients about mistakes and that health care workers are afraid to speak up if things donâ??t seem right. Many doctors and nurses have told ProPublica that they fear retaliation if they speak out about patient safety problems. Marshall Allen, ProPublica 09/23/2016 |

Baylor's Briles and McCaw Dismissed from Title IX Lawsuit |
Former Baylor University football coach Art Briles and former athletics director Ian McCaw have been dismissed from a lawsuit filed by a female student alleging Title IX violations. The lawsuit alleged that the coaches and the university mishandled sexual assault claims by the plaintiff and three other women. The women allege that they were sexually assaulted by members of the football team and that school officials failed to act on the allegations. The football player accused of raping the plaintiff was convicted and sentenced to 20 years in prison. While Briles and McCaw have been dismissed from the first lawsuit, the plaintiff's attorneys say they plan to file suit against the coaches "in their individual capacity." Florida Supreme Court Rejects Arbitration in Nursing-Home Injury Case |
Florida Supreme Court on Thursday said a lawsuit about injuries suffered by a nursing-home resident should not be sent to arbitration. The Miami-Dade County case centered on a contract that was signed in 2009 by Juan Mendez Jr. when his father, Juan Sr., was admitted to Hampton Court Nursing Center, the ruling said. Part of the contract said legal disputes would be resolved in arbitration, rather than going to court and potentially being decided by a jury. JIM SAUNDERS, Miami Herald 09/23/2016 |

State Farm Accused in Class-Action Lawsuit of Bankrolling Judge |
A number of State Farm Mutual Automobile Insurance Co. customers have filed a lawsuit alleging that the company bankrolled an Illinois Supreme Court judge. The lawsuit alleges that State Farm conspired to elect the judge in order to have a $1 billion award against the company thrown out. A federal judge recently ruled that the lawsuit will be able to proceed as a class-action lawsuit and will include about 4.7 million State Farm customers in its class. The lawsuit accuses the insurance company of lying about its efforts to elect Lloyd Karmeier for its own benefit. Jeff Feeley, The Insurance Journal 09/20/2016 |
