A Fifth Circuit panel upheld a $3.7 million post-verdict award for 108 former Native Oilfield Services LLC drivers alleging the pressure-pumping company failed to compensate them for overtime, finding Tuesday that a lower court did not miscalculate the class's damages. Native Oilfield had said that it was entitled to a new trial because the court did not correctly calculate the damages, and that the evidence did not support the juryâ??s finding. New Listeria Scare Leads Blue Bell to Recall 2 Flavors |
On Wednesday, Blue Bell announced a recall of "select products" that came from its plant in Sylacauga, Ala. because they were made with a chocolate chip cookie dough ingredient supplied by a vendor that was "potentially" contaminated with Listeria monocytogenes.The cookie dough ingredients came from Garner, Iowa-based Aspen Hills, Inc. The Blue Bell Chocolate Chip Cookie Dough and Blue Bell Cookie Two Step ice cream products were not sold in Texas, but they were distributed in 10 states throughout the south, including Louisiana. Widow of New Jersey Skier Files Wrongful Death Suit Against Teen |
A wrongful-death lawsuit has been filed over the death of a New Jersey skier in Breckenridge, Colorado. The lawsuit was filed on Tuesday in U.S. District Court in Denver by the widow of the 43-year-old skier who was killed. The complaint names as defendants the teen skier who hit the plaintiff's husband, his mother and his ski instructor. The teen was preparing for the US Snowboard and Freeskiing Association competition when the collision took place. The complaint seeks compensatory damages in excess of $75,000.
