David Bernthal: 'Hot coffee case' significant in more than one way
David Berntha, a retired 21-year federal magistrate, discusses the McDonalds Hot Coffee case/civil justice system and concludes, "The lesson here is that we should not judge a case without knowing all the facts, and we should not jump to conclusions about a process before we understand how it works."

One Lawsuit Dismissed, One Moves Forward in Stolen Syringes Case

One lawsuit has been dismissed and another allowed to proceed in connection with an incident of stolen syringes by an HIV-positive surgical technologist. On Thursday, Denver District Court Judge Jay Grant dismissed one of the lawsuits after testing revealed that none of the plaintiffs had contracted HIV. Judge Grant stated, "While plaintiffs state there is a ‘statistically significant’ chance the plaintiffs may test positive for the diseases in the future; the court finds this is too uncertain of a possibility to confer standing on the plaintiff." Denver District Court Judge Catherine Lemon found the opposite, ruling that the other lawsuit could proceed.

A dentist from Morris County, New Jersey is facing a lawsuit after a number of his patients contracted a rare disease. After a state health report, the dentist has been linked to 15 patients who contracted bacterial endocarditis, a heart infection. The report was released in July and stated that the infections were due to "breaches of infection prevention practices." Among the 15 cases of infection, there has been one patient death. The dentist's practice was not suspended, but agreed to implement changes.

More Head Injuries Reported for Babies in Stroller Accidents

An average of 50 children a day end up in hospital emergency rooms because of stroller or baby carrier accidents, and it appears far more of them are suffering brain injuries than previously believed. The finding is based on data collected through the National Electronic Injury Surveillance system, which revealed that an estimated 361,000 children 5 or younger had injuries serious enough to land them in a hospital emergency room between 1990 and 2010.
