Jury Orders San Jose PD to Pay $3.2 Million in Suit

A California jury awarded $3.2 million to a family whose children were "illegally" taken from them in 2005 by police. According to the lawsuit, San Jose police broke into the family's home without a warrant and took their two young boys, placing them into protective custody, and then their 8-year-old daughter a day later. The department claimed it was acting on suspicion of sexual abuse of the young girl, but the suit stated no abuse was ever discovered, and the officers still should have procured a warrant to enter the home. It was a year before the children were returned to their parents.  Mike Rosenberg, San Jose Mercury News  04/01/2011

Man Dies After Accident at Indians Game, Suit Filed

A lawsuit has been filed against the Cleveland Indians organization over the death of a fan after an accident outside their stadium in June of last year. The man was crushed by an inflatable slide, suffering broken bones and various flesh wounds. He was treated that day by a local clinic, but collapsed and died a week later from a blood clot caused by the blunt-force trauma. The suit claims the slide was not properly secured, and names four other companies as defendants along with the Indians.  Pat Galbincea, Cleveland Plain Dealer  03/31/2011

Doctors Sue Lawyers Over Letters of Protection

spacer image

Some doctors are hiring lawyers to sue other plaintiffs attorneys when the doctors' medical invoices allegedly aren't paid. Such breach-of-contract litigation usually involves what is known as a "letter of protection" — an agreement between a plaintiff's lawyer and a health-care provider. The doctor or clinic agrees to forgo payment from an injured client until the client's suit is resolved favorably. The plaintiff's lawyer agrees to pay the doctor or clinic from the settlement or jury verdict proceeds.  John Council, Texas Lawyer  04/04/2011
