Edith Jones Resigns as 5th Circuit Chief Judge

Chief Judge Jones is stepping away from the leadership role for “various family reasons,” but she will stay on the court as a judge. Her resignation means that Judge Carl Stewart, a 1994 Clinton appointee, will become the first African-American to serve as chief judge of the Fifth Circuit. Parents Sue Lockhart ISD Over Sex Assault

The parents of Lockhart ISD student have filed a federal lawsuit against the district for failing to protect her from a sexual assault by a teacher. It's been almost a year since a scandal broke at Lockhart High School. That was when police launched an investigation into one of the schools teachers and baseball coach Thomas Knox, for having an improper relationship with a student. The lawsuit claims that inappropriate relationships between Knox and some of the students had been reported to administrators about three months before Knox was arrested. Lafayette Settles Police Killing Lawsuit

The city of Lafayette, La., has settled a $163,500 lawsuit over the police shooting of a local man in 2008. Police officers were responding to a stolen vehicle call when the man was shot. According to court documents, the man was backing up slowly in the vehicle, which was believed to be stolen, when officers tried to rip him from the car, and eventually shot him.  Wire Report, San Francisco Chronicle  09/27/2012

UC Davis Pays in Campus Police Pepper-Spray Suit

The University of California Davis has agreed to pay nearly $1 million to settle a lawsuit over the pepper-spraying of 21 students and alumni during a peaceful protest on campus. Video taken at the scene shows campus police spraying sitting students in the face from close range, which triggered national outrage.  Stephen Ceasar, LA Times  09/27/2012

Suit: Donor Group Forces Doctors to Harvest Organs

A nurse practitioner in New York has filed a lawsuit against the New York Organ Donor Network, claiming the group "pressured hospital staffers to declare patients brain-dead for faster harvesting." In his suit, the plaintiff claims he was fired from the donor group after complaining about asking doctors to speed up medical decisions to harvest organs. The plaintiff cites one incident where donor group officials demanded a doctor declare a man brain-dead despite obvious signs of brain activity and breathing efforts.  Staff Report, United Press International  09/26/2012

Boy Scouts of America to Review Secret Files

The Boy Scouts of America announced this week that it will conduct a comprehensive review of secret files it has used to keep pedophiles from using Scouting to sexually abuse boys. The BSA keeps the files in locked cabinets at its Irving headquarters. Since the 1920s, the files have been used in the screening process for adults who apply for paid staff positions or who volunteer as Cub Scout or Boy Scout leaders. The planned review will cover files from 1965 to the present, BSA leaders announced in an open letter to the Scouting community Tuesday. Previously, Scouting leaders have denied that the files contain any relevant information about how pedophiles have gained access to children through the BSA or how the abusers were handled when they came to the attention of Scouting leaders in a local area.  SCOTT K. $4.8 Million Suit over Virginia Inmate's Death

A wrongful death lawsuit has been filed against the sheriff of the Richmond, Va., City Jail over the death of an inmate from congestive heart failure in 2010. The suit, which seeks $4.8 million in damages, claims jail officials failed to provide medication or proper care to the victim, who suffered from diabetes and chronic heart problems. On the day he died, the victim begged a deputy to call a doctor, but no medical personnel arrived to examine him, the suit says.  Reed Williams , Richmond Times-Dispatch  09/27/2012

Suit over Death at Alabama Fairground Settled

An undisclosed settlement has been reached in a wrongful death lawsuit filed against the Greater Gulf State Fairgrounds in Alabama over the death of a man in 2006. The man was leaving the fairground parking lot when the gate arm swung loose, crashing through the car windshield and impaling the man in the head.
