Restaurant Chain Owner Hit with Lawsuit Over Wages

Darden Inc., owners of Olive Garden and Red Lobster restaurants, has been named in a lawsuit accusing the company of underpaying its employees at restaurants across the country. In the suit, plaintiffs say the company forced them to work "off-the-clock" before and after their shifts and were paid less than minimum wage. The lawsuit seeks to represent thousands of current and former Darden employees.  Staff Report, Reuters  09/07/2012

Consumer Group Files Suit Against FDA

A consumer protection group has filed a lawsuit against the Food and Drug Administration over the failure to remove a high-dose Alzheimer drug from the market. The group points to FDA research that shows that high doses of the drug Aricept "doesn't work better at controlling symptoms of moderate-to-severe Alzheimer's than two low doses" and can pose severe health risks to patients. The group filed a petition in May 2011 with the FDA to halt the sale of the high-dose drug but the FDA has done nothing, the suit says.  Wire Report, The Olympian  09/05/2012

Two Companies Accused of Cheating Customers

Two separate lawsuits have been filed against Chipotle and Forever 21, accusing the companies of rounding up purchase costs and skimping on pennies from customer returns. The class-action suit against Chipotle says the company rounds its bills up to the nearest 5-cent amount, "routinely overcharging" customers. Forever 21 is accused of crediting customers back less than what they paid for items on returns by a few pennies.  Tiffany Hsu, LA Times  09/07/2012

Jury Finds For Injured Tyson Worker

A Potter County jury has awarded a Tyson Fresh Meats worker $632,395 after his arm was crushed at the company’s Amarillo plant in 2009. The verdict said Mahdey Abdi, 44, deserved $48,032 in lost wages as well as additional payment of damages for physical pain, mental anguish, disfigurement and impairment. Abdi was working on the cleanup shift at Tyson’s Amarillo beef processing plant when a conveyor pulled his hand and arm into the conveyor machinery, according to court documents.  Kevin Welch, Amarillo Globe-News  09/07/2012

State Farm Faces Criminal Investigation Over Hurricane Claims

State Farm Insurance faces a new criminal investigation in TX related to how it handled potentially tens of thousands of hurricane claims there, ABC News has learned exclusively. Gregg Cox, who leads the public integrity unit of the Travis County DA's office in Austin, confirmed to ABC News his investigators recently launched the probe after reviewing newly released communications from top State Farm managers in Texas. Some of the same communications have led to lawsuits by customers who say they were defrauded by State Farm Lloyds, the Texas subsidiary of the larger insurance company. The documents in question relate to an alleged cover-up by State Farm management related to its denial of consumer insurance claims for a common type of roof damage that occurs during high wind events and hurricanes.  MARK GREENBLATT, ABC News  09/07/2012

Suit: Police Taser Caused Man's Heart to Stop

The death of a Salt Lake City man, allegedly at the hand of a city police officer's Taser, has prompted a lawsuit against the Salt Lake City Police Department. In the lawsuit, the family claims officers unnecessarily tased the victim during an arrest in June, causing his heart to stop. The family points to a witness on the scene who says she heard officers talking about using a Taser on the man and how he stopped breathing after the shock was administered.  Pat Reavy, The Deseret News  09/06/2012
