Suit: Police Could Have Prevented Murder

spacer image

A New York woman has filed a lawsuit against the Rochester Police Department, claiming officers could have done more to prevent the murder of her daughter by the girl's father in 2011. The girl and her half-sister were abducted by their father in September 2011; the lawsuit claims police refused to issue a missing persons report, which could have led to the location of the girls before they were killed three days later. The plaintiff's attorney said the department's general policies required "a much more immediate and serious response."  Gary Craig, Rochester Democrat & Chronicle  09/06/2012

Texas Sees Rising Tide of Property-Rights Cases

spacer image

The case of Julia Trigg Crawford versus the Keystone XL oil pipeline will soon return to the headlines. Crawford, a northeast Texas farmer, is fighting to keep TransCananda, the pipeline’s owner, from invoking the right of eminent domain to cross her property. A Lamar County judge ruled against her last month, but Crawford says she plans to file an appeal soon — probably to the state’s 6th Court of Appeals in Texarkana. But Crawford’s case is only the most visible in what some legal experts describe as a rising tide of property-rights cases across Texas. Just last week, the Texas Supreme Court handed down four decisions on land-use issues, including a ruling that allows the city of Austin to take over a downtown block belonging to lawyer Harry Whittington for use as a parking garage and chilling station.  Kate Galbraith, Texas Tribune  09/06/2012

Medical Company To Settle Whistleblower Lawsuit

A medical equipment company in Mississippi will pay $1.8 million to settle a 2009 whistleblower lawsuit that accused the company of defrauding government insurance groups. According to the suit, Pinnacle Medical Solutions over-billed Medicare and the Federal Employees Health Benefits Program for the delivery of certain diabetic supplies. The main plaintiff in the suit, who initially reported the fraudulent charges to Pinnacle higher-ups, was fired in 2009 after her complaints were ignored.  Kent Faulk, The Birmingham News  09/05/2012
