Healthcare Company Hit with Wrongful Death Suit

A Pennsylvania man has filed a lawsuit against Apria Healthcare over the death of his mother, who allegedly failed to receive her prescribed oxygen from the company to treat lung cancer. In the suit, the man said he called the company multiple times on Sunday, April 22 to alert them that his mother's oxygen supply was dangerously low, but was told he would have to wait until the next day for a delivery. The woman died the next morning due to lack of oxygen. The suit is seeking unspecified damages.

Discrimination Suit Against Univ. of Missouri Revived

A Missouri appeals court has revived a gender discrimination lawsuit against the University of Missouri by a former female professor. The woman's job offer to become the head of the university's communications department was withdrawn after the two sides could not agree on compensation and job duties; the woman filed suit shortly thereafter. The appeals court has instructed a trial court to determine if the plaintiff "had a legal contract" with the university before it was withdrawn.

BMW Recalls 7-Series Vehicles

German auto company BMW has issued a recall of about 7,485 7-Series vehicles due to problems with the Soft Close Automatic Door feature. The company said that doors equipped with this optional feature can open unexpectedly while driving, even if the doors appear to be closed and latched. The recall covers 2005-2007 model-year vehicles.

Barnes & Noble Data Breached, Lawsuits To Come

Book giant Barnes & Noble has announced that hackers may have stolen customer credit and debit card information at 63 stores across the country. Customer PIN numbers and other account information may be at risk, giving the thieves access to private customer information. Legal experts say the bookseller will probably face consumer lawsuits resulting from the data breach.

St. Louis Settles Police Wrongful Death Suit

The St. Louis County counselor's office has agreed to pay $46,500 to settle a wrongful death lawsuit over a police struggle in August 2008. Police were executing a search warrant at the victim's house when the scuffle began; nine officers allegedly tackled the man and kicked him in the head "as if it were a soccer ball." The medical examiner's report shows the victim died from heart disease and asthma complications aggravated by the "violent struggle."
