Suit Filed Over Job Demotion Due to Jury Duty

A former administrative assistant in the Waco Independent School District has filed a lawsuit against the district after allegedly being reassigned and demoted due to work missed while serving jury duty. She was called to serve on a grand jury trial that lasted from July through September. Upon returning to work, she was told the salary of her current position would be cut $10,000 a year if she decided to keep it for the 2013-14 academic year. McLennan County District Clerk Karen Matkin said, “We would hope...that no employer, public or private, would take an adverse employment action against an individual on account of their service as a juror."  Tommy Witherspoon, Waco Tribune Herald  10/14/2012

Teen Sues County Over Illegal Grand Jury Interview

A New York teen has filed a lawsuit against Livingston County after being wrongly charged for sexually abusing his 3-year-old half-sister. Prosecutors during a grand jury interview had promised the girl ice cream after testimony and told the girl that her mother was watching her. Only at that point did the girl say she had been abused, despite denial in three other interviews. Charges against the boy were dismissed also in part because the interviews were shown to the jury out of order.  Gary Craig, Democrat and Chronicle  10/13/2012

Koch Facing Lawsuit by Executive

William Koch held a senior executive of his Oxbow energy company captive for almost two days after discovering his concerns about a plan to avoid U.S. taxes on $200 million in profit, the now ex-employee claimed in a lawsuit. Former Oxbow Senior Vice President Kirby Martensen alleged that an unrelated company probe revealed his misgivings over the purported effort by Oxbow Carbon & Minerals LLC. As a result, Martensen said, he was falsely imprisoned by Koch’s agents and interrogated at a remote Colorado estate as part of an attempt to intimidate him. Company Linked to Meningitis Scare Besieged as Deaths Rise

The company that produced contaminated medications linked to an unprecedented fungal meningitis outbreak faced mounting scrutiny on Saturday over whether it illegally sold drugs to medical facilities, as the death toll from the disease grew to 15. The Centers for Disease Control and Prevention (CDC) said another person died from meningitis, the second death in Indiana. The number of cases of the disease reported reached 201 in 14 states, according to the CDC and state officials.  Greg McCune, Reuters , Yahoo News  10/15/2012

Peanut Co. Linked to Salmonella Outbreak Expands Recall

The New Mexico food producer linked to salmonella-tainted peanut butter has expanded its recall to include raw and roasted peanuts, the U.S. Food and Drug Administration said. Sunland Inc has also halted production at its nut butter and peanut processing facilities, the FDA said on Saturday. The moves came after food safety investigators looking into the tainted peanut butter inspected Sunland's production line and found salmonella that DNA tests determined was identical to the strain that caused last month's outbreak. In all, 35 people in 19 states have been infected with salmonella.  Reuters, Yahoo News  10/15/2012

Wrongful-Death Suit Filed Over Fatal Drunk-Driving Accident

A wrongful-death lawsuit has been filed against a man charged with intoxicated manslaughter after killing two pedestrians and their dog. The suit also names the Galveston bar which served the driver alcohol as a defendant in the suit.  Chris Paschenko, KHOU-TV  10/14/2012
