Olympus Hit with Suit over Investor Losses

Camera maker Olympus Corp. has been hit with a lawsuit by American investors accusing the company and its leadership of engaging in fraudulent practices that resulted in investor losses. The lawsuit, which is seeking class-action status, says the company's former president and chairman, as well as the current president had engaged in "accounting irregularities." Suit: Woman, Child Sickened by Contaminated Nuts

A New York mother has filed the second lawsuit against the American Pistachio Commodity Corp. over Turkish pine nuts that were recalled earlier this month after testing positive for salmonella. The suit claims both the mother and her daughter became sick and were hospitalized after eating the nuts. Last week, another New York resident filed the first suit against the company after being hospitalized for 3 days due to the contaminated product.  Patti Singer, Rochester Democrat & Chronicle  11/16/2011

Wrongful Death Suit Against College to Continue

A judge has ruled that the parents of a College of New Jersey student who was killed on campus in 2006 may continue with their wrongful death suit against the school. The boy's blood was found around a trash compactor and his body was found in a local landfill a month after he disappeared. The suit says "lax security" at the college's dormitory may have allowed someone to enter the boy's room and kill him.  Staff Report, Philadelphia Inquirer  11/12/2011

Penn State May Seek Immunity After Skirting Public Laws

Pennsylvania State University, after years of skirting public-school rules, may claim protection from liability under commonwealth laws that shield government entities, if it faces suits related to a child-sex scandal. Moody's Investors Service is examining the school's relationship with the state to see whether claims of sovereign immunity apply, analysts said yesterday. Fallout from abuse charges against an assistant football coach and perjury accusations against two administrators led to the dismissal of Joe Paterno, the head coach, and Penn State's president.  Michael McDonald, Bloomberg, San Francisco Chronicle  11/16/2011

Judge: BP Not Covered Under Transocean Insurance, States Can Seek Punitive Damages

BP has lost two big rulings in its fight to shield itself from potentially having to pay billions of dollars more in damages related to the worst offshore oil spill in U.S. history, though the company was able to limit some of its future exposure. A federal judge ruled Tuesday that BP PLC is not entitled to coverage for the spill under insurance policies totaling $750 million held by Transocean Ltd., owner of the Deepwater Horizon rig that BP was leasing at the time of last year’s Gulf of Mexico disaster. The same judge ruled Monday that Alabama and Louisiana can pursue punitive damages against BP and other companies.  Associated Press, The Washington Post  11/16/2011
