Doctor Gaps in Texas Persist Despite Perry's Stats

An analysis of Perry's tort reform initiative in Texas reveals a more complicated bottom line than his campaign rhetoric on the issue would suggest. State medical data show that the number of physicians practicing in Texas has increased since the initiative passed in 2003, though by considerably less than the total Perry cites. And the bulk of that influx has come in larger cities where health care was already abundant, leaving large rural swaths of Texas still without doctors.  PAUL J. $410 Million Bank of America Settlement Approved

A Florida judge has approved a $410 million settlement by Bank of America in a class-action lawsuit against the bank for "excessive overdraft fees." The settlement will reach millions of debit-card customers and could pay out as much as 45 cents on the dollar on their claims. Sears Settles $100,000 Discrimination Lawsuit

Sears, Roebuck & Co. has agreed to pay $100,000 to settle a discrimination lawsuit filed by an African-American female employee who worked at several Sears stores in Oklahoma City. The woman claimed in her suit that during her 28-year employment, she "was passed over for promotion to supervisor several times in favor of younger, less experienced, white males." Parents of Child Molested by Teacher at Fairhill School Files Lawsuit

The parents of a former student at Fairhill School filed a lawsuitin Dallas County against the school after a former teacher pleaded guilty to having a sexual relationship with their daughter. The lawsuit alleges that based on criminal court documents, the teacher had inappropriate relationships with other female students at the school.  Jennifer Emily, The Dallas Morning News  11/08/2011

Oil Spill Defendants Want to Keep Investigations Out of Civil Trial

BP, Transocean and cement contractor Halliburton filed motions late Monday in federal court in New Orleans seeking to keep certain government oil spill reports out of the civil case. BP also wants a judge to bar plaintiffs’ lawyers from using past criminal, civil and regulatory proceedings against the British firm in the civil case.  Associated Press, The Washington Post  11/08/2011

Healthcare Co. Settles Whistleblower Suit

Tennessee-based Vanguard Healthcare has settled a whistleblower lawsuit that accused the company of defrauding Medicare and Medicaid. The plaintiff, a former employee at a nursing home owned by Vanguard, claimed in his suit that the company was double-billing and overcharging the programs. The suit also accused the company of "billing the programs medical equipment that actually was provided by suppliers at no cost."  Walter F. Roche Jr., Tennessean  11/08/2011
