Wells Fargo Settles Suit With City of Memphis

Lender Wells Fargo & Co. has agreed to more than $432 million in mortgage credits and investments to settle a discrimination lawsuit filed by the city of Memphis. The lawsuit claimed the company steered minorities toward loans with "higher rates and fees and terms that were less advantageous." As part of the settlement, the bank will invest $7.5 million in the city and county in home renovations and down-payment grants.  Dakin Campbell , Bloomberg  05/29/2012

Wrongful Conviction Lawsuit in Illinois to Go Forward

An Illinois appeals court has given approval to a lawsuit filed by two local men who were sent to prison 25 years ago, wrongfully convicted of murder. The lawsuit accuses a group of law enforcement agencies of "conspiring against [both men]" to convict them of the 1987 murder. The plaintiffs were released from prison in 2004 and 2008 after some key witnesses recanted their testimony.  Annie Sweeney, Chicago Tribune  05/30/2012

Jury Awards $3M in Man's Death

A Gwinnett County jury on Tuesday awarded $3 million in a medical malpractice lawsuit to survivors of a 31-year-old husband and father of two who died while having sex one day before he was scheduled to have a heart stress test. The unusual lawsuit arose after the Lawrenceville man died on March 12, 2009, while engaging in a threesome with a friend and a woman who was not his wife. It was not immediately clear in the verdict whether the patient's wife or his two sons stand to benefit from the judgment.  Andria Simmons , Atlanta Journal-Constitution  05/31/2012

Seeking Disclosure on Fracking

As the controversial oil and gas drilling practice known as hydraulic fracturing continues to spread, governments around the world are grappling with how to regulate it. One regulatory trend is becoming well-established: requirements that drilling companies disclose information about the chemicals used in fracking. In a report published this week, the International Energy Agency urged policy makers to adopt “full, mandatory disclosure of fracturing fluid additives and volumes,” to avoid sowing mistrust about fracking activities.  KATE GALBRAITH, blog, The New York Times  05/31/2012

TX AG: Mandatory Abuse Reporting Law Does Not Apply to Adult Patients

Child abuse reporting laws do not apply to adult patients who talk about childhood problems in therapy, the attorney general's office ruled Wednesday. In December, the Texas State Board of Examiners of Psychologists asked the attorney general to clarify Texas' mandatory reporter law, which requires certain professionals to report suspected child abuse or neglect to authorities within 48 hours of a disclosure. That law applies to clergy members, teachers, doctors and other professionals. Mental health providers have been required to report since 1995. Over the years, the law has generated confusion for mental health providers, who wondered whether they had to report abuse that their adult patients said happened in their childhood.  Andrea Ball, Austin American Statesman  05/31/2012

Suit: Liquor Distilleries Emit Moldy Vapor

A class-action lawsuit has been filed against three Louisville whiskey makers, alleging vapors given off during the aging process leave black spots on nearby cars and homes. According to the suit, a fungus in the vapors is leaving a nonleathal, sooty mold on surfaces near the distilleries. Plaintiffs say the companies need to do a better job of "managing their emissions."  James Bruggers, Louisville Courier Journal  05/31/2012

Nurse in Vegas Files Suit Against Former Employer

A nurse in Las Vegas has filed a lawsuit against her former employer, Sunrise Children's Hospital, after she was fired over the death of a baby in 2010. The child's death has been ruled a homicide, and police have called the plaintiff a "person of interest," but no charges have been filed. In December, federal arbitrators ruled the plaintiff be reinstated to her position, but the hospital has failed to comply with the order.  Paul Harasim, Las Vegas Review Journal  05/31/2012
