O. Ricardo Pimentel: A Key is What Constitutes 'Standard of Care' |
| “If Dr. Lindner had not performed the endoscopy, clearly Mr. Rooks' cardiorespiratory arrest would not have occurred and he would not have died.” Kenneth Hammerman, M.D. “It's possible to meet the standard of care and still have a bad outcome.” Leigh Hopper, spokeswoman for the Texas Medical Board. Those two statements lie at the heart of the case of David Michael Rooks. The 50-year-old died more than two years ago following a diagnostic endoscopy. O. O. Ricardo Pimentel: A family's Pain and a Medical Malpractice Suit |
| David Michael Rooks died on May 12, 2010. How — and why — he died is the subject of a lawsuit that will pit Rooks' family, which contends negligence, against a doctor and medical institutions that will likely claim none. It might pit experts in a finding by the Texas Medical Board that Texas' standard of care had not been violated by the doctor in this case against at least one other expert who insists that Rooks need not have died but for a needless procedure. And if the allegations of negligence are correct, it would naturally raise questions on whether the system intended to police doctors served Rooks here. O. | United Continental Holdings, the world's largest airline, was accused Tuesday of racial discrimination by 22 black pilots who allege the company offers minority employees fewer promotions to upper management than whites. Wrongful Death Suit Against Kansas City Revived |
| A Missouri appeals court has revived a wrongful death lawsuit against the city of Kansas City after a 10-year-old boy drowned in a drainage ditch in 2007. The boy was swept into a drainage ditch by fast-flowing rain water; his parents filed suit, accusing the city of negligently maintaining the area, which was "unguarded and overgrown with vegetation." Las Vegas PD Hit with Wrongful Death Lawsuit |
| The mother of a Las Vegas veteran who was shot and killed by local police in December has filed a lawsuit against the Las Vegas Metropolitan Police Department and three officers. The man was shot in his car by police officers at a local apartment complex. The lawsuit claims bad police policies and practices led to the man's death, and that officers on the scene could have taken simple measures to prevent the man's death.
