Generic-Drug Makers’ Complaints Prompt Investigations

Some drugmakers assert they are unable to create cheaper generic versions of drugs because their rivals are exploiting a legal loophole.It all comes down to process: To get a generic drug approved for sale, a company has to test a sample of the brand-name version and show regulators that the generic version is essentially identical and as effective. But the government has placed restrictions on distributing some drugs that are dangerous or prone to abuse. Critics say manufacturers of those brand-name drugs are using the restrictions to stop generic makers from getting samples to test. Facebook Settles "Sponsored" Ads Lawsuit

Social media giant Facebook Inc. will settle a class-action lawsuit over ads called "Sponsored Stories" that publicize members' "likes" without compensating users or allowing them to opt out of the ad. The lawsuit claimed the ads violated the users' "right to publicity" under California law. The terms of the settlement have not been disclosed.  Dan Levine, Chicago Tribune  05/22/2012

Lawsuit Alleges Toxic Exposure at FL Prison

More than 160 current and former employees and family members who say they were exposed to toxins at a federal prison's electronics recycling facility are suing the government. Many are suffering from sores, joint pain, memory loss and internal bleeding as well as thyroid, reproductive and breathing problems. They attribute those and other ailments to such toxins as lead, cadmium and beryllium that filled the air and covered their clothing at Marianna Federal Correctional Institution in the Florida Panhandle. Two lawsuits filed last month in U.S. District Court in Panama City accuse the Bureau of Prisons of negligence in operating the facility.  Associated Press, Miami Herald  05/23/2012

Jury Finds for Sanitation Worker

A San Francisco jury has awarded $11.4 million in damages to a garbage truck driver who suffered a spinal injury when the front wheel of his truck collapsed and dropped to the ground. The plaintiff has had three spinal surgeries to correct compression injuries but is still in severe pain, the suit says. The suit claimed the makers of the truck knew of the defective parts that caused his accident but failed to warn drivers.  Bob Egelko, San Francisco Chronicle  05/23/2012

Woman Sues Hospital Over Fall From Operating Table

A woman sued a Connecticut hospital Tuesday, saying she was severely injured when she fell off an operating table after surgery. Attorneys for 81-year-old Florence Fiedler of New Canaan filed the lawsuit against Yale-New Haven Hospital in New Haven Superior Court. The hospital said it apologized to the woman and implemented policy changes. Fiedler had a pacemaker implanted in February 2010 and fell off the table after the surgery, according to the lawsuit. Her attorney said she suffered fractures of the hip and collarbone, a traumatic head injury that resulted in bleeding under her skull and other injuries.  JOHN CHRISTOFFERSEN, AP, Bloomberg  05/23/2012

Dallas Ready to Get Tough on Deadbeat Jurors

El Paso County does not mess around... at least not when it comes to deadbeat jurors like Fernando Valdez. When Valdez missed jury service and ignored a summons to explain himself to a judge, the county issued a warrant for his arrest. t's a tactic that's drawn the attention of officials in Dallas County, which has a no-show problem of its own. Here's the problem. In Dallas County, of every 10 residents called for jury duty, only two show up. That's not how it is in El Paso, says court administrator Mike Izquierdo. Thirteen years ago, the county had about a 17 percent show rate. Today? It's between 80 and 90 percent participation.  DAVID SCHECHTER, WFAA.com  05/23/2012

Franciscan Files Tell Abuse Story

Robert Van Handel was a 15-year-old seminarian at St. Anthony's, a Franciscan boarding school, when, he said, a priest slipped into the infirmary where he was recovering from a fever and began to molest him. More than a decade later, Van Handel himself was molesting children while working as a Franciscan priest at the same Santa Barbara boarding school. The sexual abuse at St. Anthony's is included in more than 4,000 pages from the confidential files of nine Franciscan religious brothers who were accused of abuse. The internal files, coupled with an additional 4,000 pages of sworn testimony obtained by The AP, are the largest release of a religious order's files to date and paint one of the fullest pictures yet of a pervasive culture of abuse that affected generations of students at the seminary dedicated to training future Franciscans.  GILLIAN FLACCUS, AP, Yahoo News  05/23/2012
