Cleveland Prepares to Face Wrongful Death Lawsuit

The city of Cleveland has hired a private law firm to defend them in a wrongful death lawsuit over the death of two people during a police chase. The incident occurred in November 2012 when police officers thought they heard gunfire coming from the victims' car. The incident ended with 13 officers firing 137 shots into the car, but no weapon was ever found. The lawsuit was filed by the estates of the two people killed.

$7.5M Awarded to Plaintiffs in Medical Negligence Suit

A jury has awarded $7.5 million to a couple who filed a negligence lawsuit against Brookwood Medical Center in Alabama. The lawsuit alleged that the husband was left permanently impotent and incontinent after negligent care at the hospital. According to the lawsuit, the nurses failed to notify the doctor of the man's condition, which led to the permanent damage. The medical center has yet to decide whether they will appeal the decision.

Widow of Va. Police Recruit Killed in Training Files Suit

The widow of a police recruit who was killed in training has filed a lawsuit against the city of Norfolk which will be heard in the Virginia Supreme Court. The lawsuit alleges that the recruit died as a result of his instructor punching him in the head during training. A medical examiner determined that those punches could not be ruled out as contributing to his death. The case is expected to be heard in June or September to determine if it will proceed to trial.

Farmers Insurance Ordered to Pay Oklahoma Trio $15M

An Oklahoma judge has ordered Farmers Insurance and a subsidiary to pay a total of $15 million to three plaintiffs who filed claims for damage to their homes caused by a deadly tornado that struck Woodward in 2012. The plaintiffs alleged that Farmers Insurance and Foremost Insurance Group underpaid claims and used adjusters that they knew would offer low estimates, and District Judge Ray Dean Linder agreed. The judge ordered the insurance companies to pay $2 million for bad faith and breach of duty and $3 million in punitive damages to each of the three plaintiffs.

Coloplast Said to Pay $16 Million to Settle Mesh Lawsuits

Coloplast the Danish maker of medical products, agreed to pay about $16 million to settle lawsuits accusing it of injuring women with its vaginal-mesh inserts, three people familiar with the accord said. Officials of Coloplast agreed in January to resolve about 400 suits over the inserts, which are designed to support internal organs, said the people, who asked not to be identified because they weren’t authorized to speak publicly about the settlement. The accord will provide an average payment of about $40,000 for each claimant, they said.

Thoratec Warns on Heart Device After Four Patient Deaths

Thoratec Corp issued an urgent safety advisory about the use of the pocket controller for its mini heart pump after four patients died and five others were injured. The notice includes new information and labeling for the HeartMate II LVAS Pocket System Controller prescribed to 2,142 patients since August 2012, Pleasanton, California-based Thoratec said yesterday in a statement. It helps operate the company’s HeartMate II left ventricular assist device, or LVAD, which takes over for a failing heart. Patients and their caregivers encountered problems when changing to a backup controller from their main system, the company said.
