Center for Justice & Democracy: Here’s what is really true about the U.S. civil justice system

A chart is making its way around the Internet called “We The Plaintiffs ... A Closer Look at America’s Obsession with Lawsuits.” It is written by – or was given to – a company named “eLocalLawyers.” The chart is heavy on graphics and low on truth. For a truthful perspective on “tort” (or personal injury) litigation today, a far better source is the impeccably researched academic study, “The empirical effects of tort reform,” by Cornell Law School Professor Theodore Eisenberg, a leading authority on the use of empirical analysis in legal scholarship. Problems with Door Latch Prompt Honda Recall

Honda Motor Co. has issued a recall of more than 172,000 Honda CRVs, model year 2012, and Acura ILX sedans, model year 2013, to fix problems with the door-locking mechanism. The company said that, under certain circumstances, the door may not latch properly and could pop open during an accident.  Jonathan Welsh, WSJ Blogs  07/22/2012

Suit Over Woman Who Froze to Death Settled

spacer image

A settlement has been reached in a lawsuit over a woman who froze to death in Connecticut in 2009. The lawsuit named a local bar and Democratic Rep. James O'Rourke; on the night of the incident, O'Rourke drove the woman home from the bar, dropping her off about a half-mile from her home on Jan. 21, believing it to be where she lived. No criminal charges have been filed, and the terms of the settlement were undisclosed.  Christine Dempsey, The Hartford Courant  07/25/2012

Man's Appearance in 'Gang Book' Prompts Suit

A Chicago man filed a lawsuit this week against the Chicago Crime Commission after his picture appeared as a local gang leader in a law enforcement book. The suit claims the group's "Gang Book" falsely identifies him as a "leader in Roselle of the Spanish Gangster Disciples," of which he has no actual affiliation. The plaintiff says he has suffered damage to his personal and occupational reputation as a result.  Naomi Nix, Chicago Tribune  07/26/2012

First Suit Filed Over Dark Knight Movie Killings

A man who was at the "Dark Knight Rises" premiere when 12 people were killed and dozens more injured has filed the first lawsuit against the movie theater, the suspect's doctors and the film studio. The plaintiff, who was not injured in the incident, says his best friend was shot and killed, and accuses all the defendants of various forms of negligence. Many more personal injury and wrongful death lawsuits are assumed to follow.  Andrew Lu , Reuters  07/24/2012

Emails: BP Knew of Flare Issues

spacer image

The April 20, 2010, explosion of the Deepwater Horizon in the Gulf came 2 weeks after the BP refinery began releasing pollutants into the air through a 300-foot flare that is designed to burn them away. BP reported at least 538,000 pounds of gases, including 17,371 pounds of cancer-causing benzene, spewed from the flare over 40 days. More than two years later, internal BP emails and statements in depositions indicate BP ignored repeated requests for money to fix a compressor that failed, causing the chemical release.  Harvey Rice, Houston Chronicle  07/26/2012

Firm Knew Cowboys Facility Was in Danger of Falling

spacer image

The company that designed and built the ill-fated Dallas Cowboys' practice facility knew long before the giant, tent-like structure collapsed three years ago that it was in danger of falling and concealed the problem, company documents obtained by The Associated Press reveal. The emails, handwritten notes and other documents, which have not been released publicly, indicate that Summit Structures LLC knew far more about the perilous condition of the facility than has been reported and raise fresh questions about similar steel and fabric structures erected by the now-defunct Allentown, Pa., company.  Danny Robbins, AP, Star Telegram  07/26/2012

Monitors: Parkland Hospital Lags Behind Meeting Patient-Safety Mandates

spacer image

In June alone, safety monitors observed 756 instances in which Parkland Memorial Hospital staff violated infection-control standards by failing to use proper hand hygiene. The monitors also found that “critical vacancies” remain in the troubled psychiatric department. Those are among several troubling signs in a June report card for the hospital as it enters a critical stretch of its regulatory probation.  MILES MOFFEIT, The Dallas Morning News  07/26/2012

Lawsuit Filed over Fatal Wreck that Killed Twins

spacer image

A widow in upstate New York has filed a lawsuit against a dump truck driver and his employer over the fatal wreck he caused that killed her husband and his twin sister in 2011. The driver, who was allegedly under the influence of synthetic marijuana, drove the truck 500 feet across a median at 55 mph, went airborne and struck the vehicle the twins were in. No criminal charges have been filed as of yet. The suit is seeking unspecified damages.  Jon Hand, Rochester Democrat & Chronicle  07/25/2012
